Statement of Claim
Claimant says:
"Attorney Craig Donoff was the Co-Personal Representative, along with Lois Haymes, Allan Haymes daughter in an estate in excess of 50+ Million dollars.

There were only 2 direct heirs. The first was Allan Haymes' daughter, Lois Haymes and Allan Haymes' grandson, Zylo Marshall. For the record, Lois Haymes is Zylo Marshall's aunt.

Attorney Craig Donoff became Allan Haymes attorney and Co-Personal Representative at a time when Allan Haymes was legally incompetent to make his own decisions. Mr. Donoff participated in the execution of the last Will and testament which was executed on January 30, 2009 which states as follows under ARTICLE III "I Make no provision for my grandson, ZYLO MARSHALL, for reasons best known to me."

In the January 30, 2009 Trust it states as follows under Article V, 4. "The Settlor has made no provision for his grandson, ZYLO MARSHALL, for reasons best known to the Settlor."

It is very interesting to note that in the January 30, 2009 Will the statement "I make no provision for my grandson, Zylo Marshall, for reasons best known to me." is stated in the first parson.

In the January 30, 2009 Trust it states , "The Settlor has made no provision for his grandson, Zylo Marshall, for reasons best known to the settlor." is stated in the third person which suggests that someone else had control of that clause.

Under ARTICLE IV it states as follows, "If any beneficiary hereunder shall contest the probate or validity of this Will, or any provision thereof, or shall institute or join in any proceeding to contest the validity of this Will, or to prevent any provision thereof from being carried out in accordance with its terms (REGARDLESS OF WHETHER OR NOT SUCH PROCEEDINGS ARE INSTITUTED IN GOOD FAITH AND WITH PROBABLE CAUSE) then all benefits provided for such beneficiary are revoked.

Now the statement within itself "regardless of whether or not such proceedings are instituted in good faith and with probable cause" that Mr. Donoff authorized to go within the Will suggests the possibility of proceeding executed in bad faith with the word REGARDLESS in the clause.

There is evidence through several discovery document as well as a November 2005 video taped deposition in a different case that Allan Haymes struggled with reading documents and understanding question more than 3 years before the execution of the January 30, 2009 Will and Trust.

Further, With the possibility of the overturn of the January 30, 2009 Will, both Attorney Craig Donoff along with Lois Haymes, Allan Haymes daughter, produced a forged December 11, 2006 Will 11 days before trial. Trial was set for April 15, 2015. Petitioner, Zylo Marshall, Allan Haymes' grandson, received the forged December 11, 2006 Will on April 4th through an email by both Carig Donoff and Lois Haymes' attorney, Matthew Tornincasa. The cut off for discovery was on April 5, 2014 which was 10 days before trial.

While representing himself Pro Se, Zylo Marshall personally took Mr. Donoff's deposition. upon several questions asked by Zylo Marshall, Mr. Donoff stated that it was his job to disinherit a disabled person.

Mr. Donoff further committed perjury upon several questions."
