Claimant's opinion: Threats made to me if I continued to make claims against the bank.
Claimant's opinion: I am a 76 yr old widow who purchased property from Cornerstone Bank. Since Cornerstone has carried a mortgage on this property since the mid 70's, they were aware of the fact that the land has many underground sink holes. I had an underground radar survey done and provided a copy to Larry Vancurren, Cornerstone Bank Pres/CEO. During one , he informed me - "This bank is not your enemy and at your age, YOU DO NOT WANT TO BE CAUGHT IN THE CROSS HAIRS OF THIS BANK". I know cross hairs refer to guns etc, so this seemed to be a threat and I went home.My son had several lines of credit that he was not able to pay. When the bank came to take my son's equipment and auction it to repay loans, the bank also took equipment that belonged to me - which the bank had no interest in. Later, I asked how much the equipment brought at auction because I wanted paid for the item that belonged to me. Mr VanCurren informed me that he did not know how much the items sold for (value of the items would have been between $50,000 and $80,000.) He said the bank did not keep a record, but just wrote off the loans. I have a mortgage with them, along with a loan that has two vehicles on it. Included in each loan from time to time are "debit memos" used to increase the amounts due on the loans. For example, the print out received from Cornerstone on the vehicle loan was $7800 in January 2016, however a notice from the bank written in March 2016 indicates a loan balance of $9700. Print outs for the mortgage show various debit memos totalling more than $5000. adding this much to the balance due. I had a checking account with Cornerstone, where my social security retirement was deposited. At various times, Mr VanCurren would take monies from my account for reasons, not approved by me or for what I have no idea. Then, when I tried to pay my expenses - the check was returned NSF because the bank had taken the money out of my account.Several months ago I took a copy of the underground radar survey taken on this property to Mr Van Curren (first of February 2016). He informed me that the only advice he can give is for me to form an Oklahoma company, sell the property to my company and then have the company sell it to a private person without making full disclosure. An engineer from the State of Oklahoma came out to review the report and the property. He informed me "Ms Kendall, this problem cannot be fixed. Altho I cannot tell you how fast or how far the land will sink, I can tell you it will continue sinking and you should not be here. You have three choices 1) Try to sell it after making full disclosure as required by law but no one will ever buy it. 2) Give it back to the bank (I have invested$80,000 in improvements since moving here 3) Negotiate with the bank. I have tried, but do fear any encounter after being told on two occassions by Mr VanCurren that I do not want to be caught in the "cross hairs of the bank" I do not know what this means, but do take it as a threat. As of today, I have been forced to file for bankruptcy - meaning I will lose close to $60,000 already paid to Cornerstone Bank, along with the $80,000 I invested in improvements - new water lines, new electric lines, septic system, perimiter fencing for 10 acres and cross fencing and a new 40x30 ft insulated building with full electric 110/240 service. New roof on the house along with new Heat/air conditioning and carpeting.I am afraid to confront the bank in any way because of the two threats made to me earlier.
