Statement of Claim
Claimant says:
"I took my 1980 Jeep CJ7 to Coopers Automotive to check it out and see why the rpms were running low and causing the jeep to die sometimes and also to fix it so we could get it tagged. In Nashville, we must pass an emissions test to get annual tags for vehicle.
I was told there were issues with the carburetor and distributor and he would be working on these issues. He charged me $336.00 for removal and inspection of carburetor, then another $210.00 for carburetor overhaul plus $171.00 for parts. I paid this with a credit card over the phone and had the co-owner of the jeep pick it up. When she picked the jeep up, she drove to the emissions testing center where it failed. She immediately took the jeep back to Coopers Automotive to repair the issue. The jeep then sat in his lot in the weather for a total of 3 months.
I went to the shop a couple times during the work week while the jeep was sitting outside to check on the progress and was assured he was working on it and would have it ready by “the weekend”. The third time I went to the shop and discovered no progress, I decided to take the jeep back home and soon after to another mechanic.
It took 2 weeks for the next mechanic to troubleshoot the issues (while the jeep was safe inside his shop) , pass emissions and get the jeep tagged and licensed.
I went back to Coopers to dispute the charges of work that had no resolution. My argument being that he charged me before his work was complete and then did not complete the work. I explained that the work portrayed in the bill does not represent anything that was fixed. He told me he would look into the situation and get back to me. He did not get back to me so I continued to try and contact him. I was finally able to get Dwayne on the phone to try and come to some agreement. He said he would rather not proceed with this conversation over the phone so I offered to come to the shop. He then said he couldn’t do that either, but assured me again that he would get back to me and wanted to figure this out.
I have not heard back from him since. This is very unprofessional and it should be known that he is just another mechanic promising and charging for work he cannot deliver."

  • In Tennessee, an auto repair shop must present a detailed repair invoice, with estimate of costs for repairs. In this situation, because a telephone conversation did not accomplish a solution, and the business owner requested no face-to-face conversation, perhaps a certified letter may help your position. Also, a consultation with an attorney may help in obtaining a refund for repairs not completed.
