Statement of Claim
Claimant says:
"Hired the contractor, Mr. Bernard to refinish my kitchen (cabinets,drawers, and bases),July15,2010. Paid him $500.00 up front. Mr. Bernard then came to my house on 07-17-10 and took all my drawers, cabinet doors down and took them with him to get started on work. On 07-19-10, he had brought a door that was not completely finished to my specification of color. Failed to write the correct stain color down at the time I was deciding on color. He told me then he would bring it back next day finished. Never showed up, I called him to discuss my door sample. On 7-20-10; after I contacted Mr. Bernard he then told me his truck needed brakes, so if I could pay him $200.00 more he would come and start the job and be at my house on Saturday & Sunday. My ex-husband had to give Mr. Bernard a call and discuss his inabiltiy of no show and what was going on with not being able to perform his service. My ex-husband then told Mr. Bernard he needed to bring contract, so we could document the monies already paid to him, incase he bailed. On 07-23-10 he came over and we talked about getting some work done and brought a stain color over for me to look at and did the staining in my front yard for the sample, (which I was not exactly happy about doing a staining quickly in my front yard.), but then I did go ahead and pay him $200.00 more because he told me he had been working on my doors and he had the sample ready. Mr. Bernard came to my house on 7-24-10 and started preping kitchen for bases to be sounded down. He brought a helper, and they preparing and sanding. I was gone for a couple of hours, but had my ex-husband at my house and was called to come back and look at what Mr. Barnard was doing, since they only worked 2 1/2 hrs and then left. Arrived and seen he had sanded very very little and started staining over the original stain. The bases looked horrible, he still had stripper solution on bases and it was bubbling and very little sanding was done. At this point Mr. Bernard and his helper had started staining over the bases, and they looked horrible! It looked like something a first grader would attemp to do without supervision. Mr. Bernard and helper showed back up an hour and half later. Talked to him and he told me it would dry and he would be back on Sunday to fix it. Sunday came around and Mr. Bernard NEVER showed up like he had told me or my ex. My cabinet bases looked horrible. On 07-26-10 told him to bring my doors and drawers back completely sanded; since he had told me he had already done them and was almost through. He would not bring my doors that Monday evening and said he would come to my house on 07-27-10 early before 7:00 a.m. and give my stuff back. He didn't do it; so I had to get a friend to take me to his house and pick my drawers and cabinet doors out of the back of his truck. The doors or drawers had not been sanded like he said they were. Still to this day I have been working slowly in sanding the bases down from the stain he put on there. Had to redo everything he started or did."
