Claimant says:
"House was restored after a fire loss. Many items were charged and paid by the insurance company but were not put in the house."

  • No a rep was not sent from manufacturing company, when I questioned the man who you sent out there, he said he worked for Tim Tuelle, not the manufacturing company. All I want is for you to meet the insurance man and myself at my house to tell me what you are going to do so I will know what to do.

  • The representative sent does all of the warranty work for CMC supply where the tubs were purchased. As we informed you they were no longer under warranty due to the length of time that had passed before you notified us that there was a problem, therefore we had to pay for the service, he does not work for Tim Tuell, the project manager sent with him does work for CRS so perhaps you were confused. We would be happy to meet with an insurance representative, just let us know the date and time of the appointment.

  • We can meet with you on the 14th of March at the house around 10 am. I have arranged for Bill from the insurance company to be there at this time. If for some reason this is not good for you please let me know. Thank you and looking forward to resolving this matter.

  • I am assuming you will not be able to meet us on Wednesday since I haven't heard anything back from you. Please let us know when it is convenient to meet you at the house. Thank you!!

  • We did not receive your message on March 7,2012. This is the first we are hearing about this meeting, we can however meet at 11:00 tomorrow if that is acceptable, if not let us know.

  • I just received a phone call from the project manager, he will not be able to be there until Friday, March 16, 2012 between 10:00 and 11:00am. Let us know if that will be acceptable. Thanks.

The claimant's settlement terms were rejected with the following explanation:
  • I disagree with the explanation / grounds provided

    "Due to Mr. Smith's incarceration we were working with his POA Rhonda Smith as well as Jody Smith Jr. and Margaret Smith, who made the selections for the fans,lights and tubs. We could not get the mirrors that were in the home so they traded them for a chandelier. As for the tub we sent the manufacturers rep to the home to resolve the issue and Mr. Smith would not let him make any repairs or listen to any other suggestions. Everyone involved at the time agreed that the repairs were satisfactory and signed a certificate of satisfaction. "
