Statement of Claim
Claimant says:
"I was charged $199.00 for my lawn being mowed. My Husband and our friend Antar worked on the lawn for at least 7hours. Antar was paid by us 100.00 for his services. I left 5841 Boone Ave. N. Approximately June 20th 2012. The reason I stopped taking care 5841 Boone Ave. N. Dale (Husband) and I (Jeri Bennett) received letters from Mortgage Company stating we needed to leave the house about the 26 or 27th of June 2012 due to non-payment of Mortgage. A Sheriff would be involved without cooperation. My realtor (Sharon) contacted the mortgage company approximately mid -August to make arrangements for a Short Sale which was accepted. Dale and Antar went to the house Within 2 to 3 days to take care of lawn. The backyard had grown at least 2 ft., in some areas of the yard had grown up to 4 feet due to weeds etc. I called Mr. Markham after receiving the water bill having charge of $199.00 for lawn care services. I left a very detailed message and received no response. During said time period I had called City of New Hope to cancel my services to notify I no longer needed services. I was not allowed to. Which I continue to receive charges, every month for several different charges, and of course tax. I am broke hence not paying mortgage due to said fact. I am at the City's non mercy policy apparently. My current water bill is $ 331.11. I am being forced to pay the Water bill; I do not believe I should have to pay due to moving no longer being a resident of New Hope. The $199.00 plus late charges is a further insult or should I say injury. They are charging an outrageous amount for said service. A normal rate would be $ 29.95. I can’t believe though my current financial circumstances is grim the City of New Hope would prefer to prosper."

  • What other sorts of charges was the city attempting to levy against you? The water bill would continue as long as you are the record owner of the property, but other charges may potentially not be warranted. However, cities do have anti-blight ordinances that allow penalties to be incurred when properties have fallen into disrepair. If the fees and penalties are associated with those rules and ordinances, it may be very difficult to argue for not having to pay them. Have you worked out some form of payment arrangement with them? Perhaps a more reasonable payment arrangement can be reached.
