Statement of Claim
Claimant says:
"i moved in an apartment with caldwell reality and the landlord (linda holmes) told me people who rent this place usually don't live there very long because it is so small and said if i found a bigger place that i could move and there would no problem after 6 months. I moved in on july 2012 and jan 2013 i moved into a bigger place. i gave linda holmes a hand written letter letter in Oct 2012 stating i was moving by jan 2013. when i went to return the keys to ms. holmes she asked why was i moving and i reminded her of what she said about me moving after 6 months and she said okay. then i asked about the return of my deposit and she said i would recieve it withn 30 dys instead a recieved a cert. letter saying i broke my lease and i was not getting my deposit back. i called ms holmes about the matter and she told me it was common knowledge that she meant moving within their properties. that was not what she told me when i first rented the place and the list of things wrong with the apartment that i had to fill out before i could move in was never repaired. i have copies of documents from the lease (month to month) , the list of things wrong with the apartment and the letter that i wrote to her in oct about my moving. all i want from this is my deposit back nothing more"

  • I would normally agree with you Sara Baxa however I have looked over my lease and I found two things first the lease Ms.Linda Holmes gave me was not my lease she gave me the lease of the person who was renting the place before me (a month) and they only lived there 6 months as well. I have contacted Linda Holmes about this and she says she has no idea how I got that and she is sending me a copy of my lease. And two I gave Linda Holmes a hand written letter in Oct of 2012 letting her know that I found a bigger place and was moving by Jan 1 2013. It is hard to over look that Linda Homles has done this before to some one else. All I want is the return of my deposit nothing more and nothing less.

  • It does sound as though there was some miscommunication between you and Ms. Holmes. It sounds as though she wasn't specific when she indicated people tend to move to bigger places. It does make sense she meant within their properties because she wouldn't be a good landlord if she encouraged people to move out of their properties soon! However, if you had a month to month lease, read the lease to find out the notice you needed to give. If your lease was month to month the entire time, you probably wouldn't have broken it by giving the notice you did. Of course Ms. Holmes interest is to keep tenants occupying her properties and since you left, she has lost money. However, hopefully she is looking at the bigger picture of referrals from satisfied tenants and will work with you regarding the return of your security deposit. Your answers will be found in your lease agreement. Best of luck in resolving this claim.
