Statement of Claim
Claimant says:
"I purchased a harp from the music shop via EBAY (paying by PAYPAL) which I received in August 2015 from the USA to my address in South Africa. When we took ownership of it, we discovered that, in addition to shoddy workmanship, it contained a number of cracks in the wood that was not from damage in transit but purely from the original condition. When we tried to play the instrument, the strings were buzzing making it impossible to use it.
We recorded the problem, plus sent photos to the seller as anecdotal evidence to support our dissatisfaction. A series of communications ensued with the General Manager, ANDY GOUGH, without resolution so the problem was escalated for arbitration with PAYPAL. They supported my claim as clearly the merchandise was 'Not as described' with a $420USD refund subject to return of the merchandise.
Unfortunately, although I returned the item with tracking, because it was sent via the Post Office International Ordinary Mail, the merchandise did not arrive within the prescribed time allocated by PayPal. I had been given a time-line from the Post Office of a 4-6 delivery period, but although I returned the item on 23 September, it only left South Africa for the USA on 16th October. Therefore, it only just arrived in December, after the deadline set by PayPAl.
The seller later offered to refund me in full for the return of the merchandise, but although I have been emailing him for a period of time, he has not been willing to respond and is ignoring all communications."
