Statement of Claim
Claimant says:
"I Thomas Weilbacher recently tried a pair of hearing aids at Bower hearings Center after looking at their add in the Cincinnati Enquirer. I am a 70 year old man with ADHD. This was a very high pressure sales pitch. I asked to try them out. Just take them home you will them. After taking them home my wife said we cannot afford this especially with me being treated for cancer. After three days I returned them and said I could afford them. They were so high pressure only offering them the most expensive hearing aids they had. When I entered the store I told them that I only needed something to get by with as my hearing was not terrible. I did not think I was buying them. I have appealed with Synchrony Bank, and lost my appeal. Bower hearing aids said I owed them 600.00 dollars for their high pressure time and 5 minute hearing test. I may be wrong but it was so high pressure. I think it was a scam to get me to buy their product. I know you have had other people complain about them. Help me if possible"

  • Our ability to refute this claim is restricted due to HIPAA rules and regulations. What I can say is this. All hearing tests are free of charge and take about an hour and a half for a complete test and demo. At the end of this test the patient is shown the results and these results are discussed. After that there is a discussion on how a patient goes about daily life, the situations they are in, environments, etc. It is all this information combined that then determines where you start on the scale for hearing aids. If you were offered the top of the line in may have been due to your hearing loss, specific requests made, or your active lifestyle that may have contributed to the recommendation. All those who wish to move forward and see if hearing aids are right for them are always offered a week to try them out. All we secure is a credit card in case they are not brought back in working condition. Some choose to purchase hearing aids that day as well as there is a 30 day return period for hearing aids. The reason we offer the trial period is because when you purchase hearing aids your are buying a brand new medical device and not just using our demonstration products. If you choose to return hearing aids that have been purchased there is a 10% return fee. This fee covers all our costs with time spent with the Audiologist as well as the cost incurred because those new hearing aids we sold can no longer be sold as new hearing aids again. The links that connect the hearings aids to the speakers that go into your ear must be thrown away. They cannot be sold again. So I do apologize you feel the way that you do. As we explained to you over the phone this is part of the contract that you signed when you purchased hearing aids and explicitly initial the portion that states you are due 10% less for a refund for the reasons I mentioned above. I must assume since you decided to purchase hearing aids that you did in fact qualify for a pair of hearing aids and liked the results enough to go through with a purchase that day. We have many other options and since you chose to return I'm sure lower cost options were at least presented to you at that time. Those options are still available to you and as stated on the contract the 10% fee we collected is available to you as store credit should you decide to purchase a lower cost set. This offer will always be available to you as long as you need. I will be happy to get something for you that is not only affordable for you but will certainly increase your quality of life over wearing nothing.
