Statement of Claim
"We bought a new 2013 Travel Trailer on 4/18/2014. We had agreed on a price for this trailer and when we left TN a day or two after our purchase, this trailer was PAID IN FULL. Today, 5/15/2014, we receive a letter from BOATNRV requesting we send them another $965.90 for sales taxes. (We had received a telephone call from their office requesting more money but I told them I wanted this in writing) My specific complaint is this falls under the ole bait and switch scheme as we would NEVER agree to pay more for something AFTER THE FACT! Secondly, our salesperson plus this dealership were well aware that we were from out of state (MI) as they bought our trailer as a trade in. Thirdly, we will not send this dealership the title to our old trailer plus the paperwork for a new shower door plus two TV's that we had installed in our old trailer UNTIL this problem is solved. The manufacturer's statement of origin should be sent to: Secretary of State, 1759 Barlow Street, Traverse City, MI 49686. Our satisfaction will only be satisfied by our getting the TITLE for this travel trailer. Absolutely. no additional money as we feel we bargained in good faith and know we do not owe a cent! • The idea that Boat-N-RV dealership in Rockwood, TN could believe that we would consider paying more for our travel trailer AFTER we--every step of the way--made it abundantly clear we were interested in our "out the door" cost is mind-boggling!

Our OK'ing paying MI taxes WAS included in our final price, you know, our out the door price! The responsibility of collecting enough money for Michigan was and is you and your dealership's responsibility. Never in our life have we ever had such a brazen attempt of a business trying to squeeze more money out of a paid-in-full customer.

  • I replied to this yesterday evening and for some unknown reason, my reply is not showing up in my "sent" mail. It shows up on this page so I'll wait a few days to see if the Boat-N-RV dealership has received it.

Thank you for accepting our complaint. We are canceling our 6-22-14 camping trip we had scheduled with two other couples as we decided our camping days are over until we can make another trip to Tennessee. Our next step in this process is to file a fraud charge in the small claim's court. You have done what you could so now we will move to the next step---I am grateful we do not have to hurry! Again, Thànks. Anna/Bob

Respondent's Counteroffer Hide
The claimant's settlement terms were rejected with the following explanation:
  • "This dealership is located in Tennessee, which allows a credit for value of a trade-n vehicle for the purpose of figuring sales taxes. Our customers home state, Michigan, does not allow for this credit. We cannot register the vehicle in Michigan until such time as our customer tenders the full amount of sales taxes due for their purchase.

All of Dealer's paperwork indicated that the amount collected to register the vehicle was an estimate calculated to the best of Dealer's ability. All of the paperwork also indicates that our customer is responsible for any and all taxes due for the purchase of the vehicle. When the registration was processed by Dealer's vendor, it was rejected due to the insufficient amount of the sales taxes collected.

This was not a bait/switch. The additional money requested is due to the State of Michigan and not to the Seller of the vehicle."
