Statement of Claim
Claimant says:
"I originally made an appt for furnace tuneup for a discounted price of $89. Just thought it would be a good deal. A field supervisor Pat came out on a Friday,late in Jan 2012, took pictures, said I had a small crack in my old furnace heat exchanger (16 years old), in danger of causing a fire. A second person showed up at the door, and took pictures as well, stated he found a long crack in the tube of the heat exchanger. Supervisor refused to reconnect it unless I signed a waiver releasing them from responsibility. He actually asked me to write a letter, which I did. He then proceeded to sell me a new unit, writing on a sheet of paper what I would be getting and the benefits of a high efficiency furnace and air conditioner. "Promised" it would be so quiet I wouldn't even know it was on. He also wrote that the furnace would be an Amana. That seemed like a reputable brand. Mind you, I have never had a problem with my old furnace or air conditioner (Carrier). For $10,432, I would get a top of the line product with 80% efficiency. Offered to set me up with financing - called Ener Bank who offered to lend me the money "same as cash" which means I must pay it off in one year or get stuck with high interest rate retroactive to the date of purchase. Very nervous about living with a cracked furnace, I bought the Amana. Beutler agreed to install it that Sunday. They did, and they installed a Goodman ("made by Amana," they said). I looked inside the equalizer and couldn't see any cracks, felt a small rough spot underneath one of the tubes, in an area not visible to me. They also came out on Monday to clean the ducts for an extra $669. Two hours after they left on Sunday, the heater started making a loud humming noise. Two people came out and attempted to resolve the problem by turning down the fan speed. That didn't work, and it hasn't stopped since. They don't seem to know what it causing it, and have been playing around with the settings. It keeps me awake at night, turns on and off every few minutes. Another supervisor Neil came out last Saturday 2/4/12, and changed the timer setting, stating that there is nothing wrong with the motor, loud air sound is normal, heard the loud humming sound, said he adjusted the fan so that it would only come on every 8 minutes. He didn't know what was causing it, but stated he would talk with his people, and phone me this last Monday 02/06 or Tuesday 02/07. He never called me back. I finally phoned him today, and his screener stated he would call me back tomorrow. This problem happens at night when heater is turned on for the night. I have been told to turn off the 2nd story heater and let the 1st floor heater do the work, heat rises. I would have to turn the 1st floor to 75 to get enough heat to my bedroom (vent is open). Motor hums away, hot spot in hallway. Then I flip it the other way, 2nd floor on, 1st floor off, same noise. Both units turned on, same thing. Doesn't matter what I do. The unit still goes on and off every 1-3 minutes. First you hear the air (loud) then the second humming sound kicks in (also loud). Once in awhile there is a thud when it shuts off, other times there is a clicking sound. Very nerve racking. My old unit was so quiet. Not once in 16 years did I ever experience anything like this. Also, there are cold and hot spots. This is very distressing. The contract states that if they can't fix it, they will replace it. They seem to be stalling. To boot, the heater seems to be working harder than my old one, and my 30% savings are going right out the window."
