  • In reading your letter that you wrote to Bank of America, I have a few questions. When was the investigation of the charges originally done by Bank of America? When did they tell you the results of their investigation (denying the claims)? Did you have any immediate contact with them after this investigation? Is this something they have already reported to your credit report? You mentioned in your letter that you have spoken to an attorney about this situation? If they have followed the correct procedures under the Fair Credit Billing Act, and determined through an investigation that the charges were correct, they should have sent you a letter detailing their investigation, at which point you could request the documentation that they relied on for that investigation. If they have determined after an investigation that the charges are correct, they can refer you to collections if you refuse to pay the disputed amount. If you feel that the investigation is not correct, you can file a complaint the Federal Trade Commission. You should keep track of all communication and documents received from Bank of America for the time period.
