Statement of Claim
Claimant says:
"My computer was running slow. On September 14, 2015 I purchase a Software name: Avast Cleanup (1 PC, 1year). Order ID #: 11792515347, product SKU: GMF-002-001-12-AR for a total of $35.88. The next day, September 15, 2015, I called AVAST at 1-866-951-7679 and was directed to another Department at 1-877-204-9327 to download the software to my business computer to clean it up, to get it running fast. During the installation by AVAST technician who identified himself as John, he told me that there were unsed programs on my computer that needed cleanup and that it would be better if I pay AVAST the total sum of $179.99. The amount is a 1 year maintenance cost at the rate of $14.99 per month, for them (AVAST) to clean and maintain my computer each year. I asked, if the $35.88 already paid, a portin of the $179.99. He said that the $179.99 was for a 1 year maintenance service. I agreed and charged the amount to my business (Meaway Security Services) Debit Card (9/15/15). After making the $179.99 payment, John started the work and later that evening, another AVAST technician who also identified himself as Pierce took over the service. It was getting late (about 8:30pm to 9:00pm). I told Pierce that I had to leave. He told me to leave and that, when he complete the service, he will leave a note on the desktop for me. When I retured the following day (9/16/15), I saw a note stating that the work was done sucessfully and directed me to access the computer as I usually do. I try several times, but couldn't open any file or even shut off the computer, using the mouse. I called AVAST and another Technician answered the phone and told me to disconnect the computer from the electrical outlet and re-connect it. I did it several times, but the computer didn't come on, except, a blank moniter with blue background. After trying for about 30 minutes to 45 minutes, the AVAST Technician told me to take my computer to a Local computer repair shop for repair and said that he is sorry about the situation. Today, 9/17/15, I contacted AVAST Customer Service Center and requested a refund of $215.87, the total amount paid. After explaining my reason, the person on the phone at AVAst directed me to another person and that person directed me to another person and so on and the phone disconnected. Later, I called AVAst again and a person answered and identified himself as Jeff N, Representative of AVAST. I told him my reason for calling. The person told me he cannot authorize refund and that he can not direct me to anyone who can. I contacted by bank of the situation and was informed that the transactions has not been posted and that within 15 days if AVAST do nothing, I should call for a claim to be file against AVAST on my behalf."
