Statement of Claim
Claimant says:
"I called Avas Flowers to order a Red & White Sympathy Standing Basket (Order attached) for a funeral. Their website stated that the cost was $89.99 for the deluxe medium arrangement. When I was about to pay with a credit card, the employee said that the charges were $112.00. When I asked why that was, they said that there is a florist fee. I suggested that they state the extra charge on their website because I felt that it was false advertising. I also paid an extra $3.99 for a full-size card. They also told me that since I was a new customer that I would get an additional 10% off the supposedly sale price. In the end, they did not give the extra 10% discount. Since I had a budget for the flowers, I told them to cancel the order. They then offered the same arrangement at a cost of $98.53 because I had told them that the price was above my budget.

The website clearly said that the arrangement was a standing basket; however, when the arrangement came, it was NOT on any kind of a stand. Also, there was a small card attached but it wasn't what I paid for. When I called Avas and told them about both problems, first they blamed the funeral home for not providing the stand, when I said that we paid for a standing arrangement and that should have been their responsibility, the person then lied and said that when they got to the church, they were told to put it on the floor (another lie). I then said that we paid extra for a full-size card and they said that it was delivered, but the card with the flowers was the small free one that comes with the flowers.

I then asked to speak to a manager, after waiting and waiting, the same person came back on the phone and said that the manager was too busy. When I asked about getting reimbursed for the card and the flowers, he said that they would only reimburse me for the card. When I told him that we paid for a standing arrangement, but did not get one, he then said that it was the churches responsibility to provide the stand. This company told me one lie after another. Their website states that it is a standing arrangement and it shows a picture of that. The customer should not have to worry about who is providing the stand!

This company is fraudulent and I would like to be credited because the product they sent was not what they advertised! I am attaching the order so that you can see that it states that it is a standing basket."
