Statement of Claim
Claimant says:
"I went to Auffenberg Mazda on 11/07/15 to test drive the car, I had to deal with uncomfortable with their sales tactics. I talked with Jon Ballas the salesperson, then I had to deal with the sales and finance managers. I told them numerous times that I wanted to discuss this matter with my dad, the finance manager told me to call my dad at work (I would only call my dad at work during an emergency situation). I was told by an attorney to post the complaint here as well, I also filed a complaint with the Attorney General in Illinois, I have heard back from the Attorney General yet. Auffenberg ran my credit twice because I am using Lexington Law Firm for my credit issues (I am a victim of id theft which I told them that). I can't get a car loan at this time. I have 2 inquires from Auffenberg Mazda because I spoke with someone at Chase Auto Finance and they confirmed that the application was submitted by Auffenberg Mazda on 11/07/15. Lexington Law Firm confirmed there were 2 inquires from the same source on 11/7/15. I am trying to buy a car but I am unable to."

  • I am willing to settle this matter for the following, a gently owned used car (year 2012 and later) and the remaining of the $24000 in a cashier's check by 2/10/16 or this matter gets published online. I had to deal with uncomfortable sales tactics. I am in a rental car right now and it is $150 per week, so I need this matter settled asap.

  • The $24000 amount came from the cost of the 2015 mazda I test drove that day. I believe is a fair settlement considering what I went through.

  • I just test drove the 2013 Kia Soul today and going tomorrow to do the paperwork. I need this matter to be over and I will definitely sign a nondisclosure agreement. I can't have anymore inquiries on my credit.

  • I had to get another car today and I had to have my credit ran, it is down 35 points because I now have 6 total inquires (Auffenberg Mazda placed 2 hard inquires on my credit on 11/7/15, I only approved 1 inquiries and the one today). I can't keep having my credit ran. Preferably you have should 4 or less inquiries on your credit report. I need this situation to be resolved. I can't have anymore inquiries on my credit for 2 years because I will need those inquiries to leave my credit. I am trying to get Capitol One Auto Finance removed from my credit but they advised they have credit application sent over to them on 11/07/15, they are making me send proof that I never authorized. I am currently working with credit law firm on this because he told me that Capitol One is difficult to remove because they make go through unnecessary steps to get items removed even though this is not my fault. I do not think this is fair.

  • I went to Auffenberg to get a 2013 Kia Soul but now I have been notified that I have 10 inquiries dated 2/7/15. Now my credit score is now totally trashed, I have 11 inquiries from Auffenberg total. I am going to have a difficult getting them removed, I am entitled to financial compensation. My credit score is not going to improve for awhile, I already spoke with Lexington Law Firm, they specialized in credit report clean up, why did I have so many inquiries on my credit. This is crazy, I am trying to get most of them removed.

  • I just received notification that 6 more inquiries from Auffenberg with a total of 16 plus the other inquiry from 11/7/15. I also talked with Transunion and because I have so many inquiries on my credit, it makes me a credit risk. Those will continue to hurt my credit for a 1 year but will not come off for 2 years. I am asking for $24000 which I want the car paid off and the remaining balance in a cashier's check, I am off on President's Day if they want to get this matter resolved by then. I will print out all of those inquiries. The inquiries dates are 2/6/16 & 2/7/15. I need to get those inquiries off because my credit score keeps going down, I was told by Transunion yesterday that all of those inquiries from Auffenberg will count as separate inquiries and my credit will continue to be impacted.

  • The settlement total is $27009 because I now owe my dad $3000 (the down payment for the Kia Soul). I think this is a very reasonable settlement considering what has happening with the numerous inquiries on my credit. I am willing to discuss over the phone. My dad paid this on Monday, I have a copy of the receipt.

  • I talked to Danielle in the Chase Auto Finance on Wednesday and she advised the financing would have come from Chase not Mazda. No one from Mazda ever disclosed that information to me. The finance manager from Mazda never mentioned everything about having 2 inquiries from my credit. Danielle advised me they should have told me that since I told them I was concerned about having multiple inquiries, I just found out this information last week. Danielle states that the dealership was suppose to disclose this information to me, I only found out about Chase Bank because it was on my credit. I was misled and I am willing to file legal action due to misinformation given.

  • I spoke to Danielle from Chase on Monday and I recorded the call as proof, she advised the dealership is aware that Mazda Capital Services is Chase Auto which no one disclosed that information to me, they only discussed Mazda not Chase at all, but the loan was approved by Chase. The finance manager only mentioned Mazda, why did they hide that information. Danielle also advised me that she called the dealership to get a letter from the sales manager at Mazda and he told her even though no one ever discussed the loan being through Chase. The credit bureaus state that it came through as 2 inquiries not one. Danielle explained that Mazda screened my application and then submitted thru Chase. I had no idea who Chase was because I told the dealership that I was concerned about multiple inquiries if they would have told me that I would have 2 inquiries on my credit, I would have declined. I also had John Ballas, a sales consultant call me everyday for about 2 weeks even though I told the dealership numerous times that I will not buy a car that day which I did not. I have the call with Danielle recorded as proof.

Message from Claimant: My dad had to pay my down payment for my car, he wants his money which I do not have. I have the receipt, if he did not pay the down payment I wouldn't be able to get the car. He wants his money back as soon as possible because he took the money out of the bank.
