Statement of Claim
Claimant says:
"There is a false review on angies list from a client named Rick Mora. The information stated in the review is misleading and wasn't close to the situation at hand. It was supposed to be a review, but instead it was a bashing of our business. We need to remove the review from angies list."

Respondent's Counteroffer Hide
The claimant's settlement terms were rejected with the following explanation:
  • "Thank you for bringing this complaint to our attention. We always appreciate the opportunity to give our side of the story regarding complaints filed against our company.

As you may know, Angie’s List allows consumers to post comments regarding experiences they have had with area companies. Angie’s List is a passive conduit for these comments, meaning the content is wholly supplied by the consumer members. Because other consumers rely on the statements made by each member, we require each and every member to sign the following statement before submitting a report:

    * I confirm that the information contained in this Service Evaluation Form (i) is true and accurate and (ii) represents my actual first-hand experience. I acknowledge and understand that Angie's List is relying upon the accuracy of the information in order to serve other members. I confirm that I do not work for, am not in competition with, or am not in any way related to the service provider in this report.

In turn, we allow service providers to submit their own opinion. After agreeing to terms similar to the above statement, Angie’s List will post the Service Provider’s account of the experience without requiring proof of the facts therein. In this model, Angie’s List does not act in the capacity of judge or jury; we do not decide who is right or who is wrong. Rather we are a conduit through which information is allowed to pass. Thus, the court of public opinion is able to decide which argument has merit. We encourage service providers to view negative reports as opportunities to show how they handle conflict. Members want to see whether companies handle conflict in professional, customer-service oriented ways.

I find it regrettable that Long Hill Auto was left feeling no other recourse than filing this complaint. However, I believe that Angie’s List is operating in the best interest of the community by allowing feedback, thus I cannot remove the report in question.

Thanks again for the opportunity to respond to this complaint.

  • Unfortunately, the only way to combat negative or untruthful reviews on sites such as Angie’s List is to respond to them in some way, if there is an option for rebuttal. If the review is false, you do have rights against the actual third party poster, but third party review sites are actually not responsible for postings on their sites. Angie’s List, as well as other third party review sites, is protected by the Communications Decency Act of 1996. Perhaps writing a rebuttal to the complaint, indicating why you disagree, will assist you in the long run because other prospective customers will see that you respond to complaints and are proactive in responding to issues.
