Statement of Claim
Claimant says:
"On Sept 29, 2016 (I was preparing to leave on a cruise the next day) was the first time I was serviced at this business; requested a Jell-Manicure and Jell-Pedicure and 2 people(Males) serviced me, 1 for hand and a person they called "To-Man" for my Pedicure (feet)...I had my 5 yr old daughter with me at the time... her nails were painted by another Female Manicurists while I was getting my feet down (I took a picture of my daughter getting nails done) and was resting my eyes during a chair massage. As To-Man proceeded to massage and oil my legs (which is part of procedure) he took off my 14K Gold Filigree Anklet with a gold solid chram ...I thought that was odd but maybe it part of their procedure. I was still enjoying the chair massage with my eyes closed...(at this time I was rush and tired)...
I didn't notice my Anklet was on my leg until the next day while getting rushing ready for cruise..(decided I would check back with nail shop after 3 day trip...So upon my return on that following Monday...I drove to Nail Shop and both men who serviced me were there...I asked for my ankle and at that time I realized To-Man didn't speak English...So I spoke to the man that serviced my hands...He was speaking in their language and I was told that the ankle was given-ed to me. I was quite surprised and responded "No you didn't) So I approached the owner "Sally" who was also there the day I was serviced... While she was servicing a client, she said, He said that he gave it to you! I responded why would he give it to me instead of putting it back on my ankle from where he took it! I said, look, I just want my 14k ankle... So Sally started speaking to To-Man in their language; so he started looking around the chair that I was serviced at days ago...Sally said we can check the video; I said yes! Lets! Sally asked me to have a seat while she figure this out...I seat for over 30 minutes with no response or action to a solution...So I said, listen, I have to go, don't have time for this! Sally's response was they needed to contact the person who setup video because they don't have the password... I asked where is your Business License so I can take a copy it?... Than Sally said, we don't want know trouble; the other male (hand) quickly and asked for my contact and advised me they would contact me once they reviewed the video..but they didn't have the time...I quickly thought...the picture I took of my daughter getting her nails done would have a time stamped! (located pic in phone and provided the time) Advised Sally (Owner) I would give the 5 business days to get back to me...
After days passed after deadline given, I hadn't heard. Oct 7 called and spoke to Sally who advised me she tried to call; my response "you must of had the wrong number, she proceeded in telling me she reviewed the video and saw a customer pickup the anklet while she was serviced in the same chair...My response was where on the chair? She never cleared when and where the anklet was picked up. Sally (owner) stated they were not responsible for my anklet...I insisted that they were because 1. It was my first time there and wasn't aware of how their process went 2. I was never given my anklet in my hands for safe keeping 3. You, (owner) are responsible for your staff faults in conducting your business 4. If you don't resolve this issue, I will file a complaint on you... Sally agreed to try to resolve this issue...I told her that I would replace my 14k anklet and expect reimbursement or trade credit for services in her nail shop...She verbally agreed...So when I replaced the anklet, I called Sally again and asked how to get the receiptof replacement to her...She told me to mail it to the address of the shop...So I did on Oct 28 via regular postal service. On Nov 13th, I called Sally and asked did he receive my billing statement of purchase of the 14k Anklet and she said yes! I advised her that I tried to find a better price and tried to get the better price; total was $302 and wanted to know if I could make an appoint that day. She stated, you can walk in...So I did. When got there, I signed in and took a seat...Her work station is near front of door...So I announced/identified myself to her and she nodded while working on a client... When the staff asked me openly what I wanted to be serviced for I said Jell Manicure and Jell Pedicure...2 people worked on me, same man (hand (did feet) and a lady did hand...I mentioned to the man about the incident of the anklet and showed my ankle with the new replacement anklet on it..and they proceeded , after completion, the lady presented me with a $55 bill, I told her to give it to Sally so i can sign off...She spoke to Sally and she wasn't in agreement..So I provided my tips to both servers and told them I would speak to Sally myself...So I respectfully approached Sally and asked her to apply this charge to my credit balance...Sally said to me, that is not what I agreed to, I just told you to walk in and I don't think it's fair that I have to pay..To-Man isn't here today, on and on ( my thoughts at this time is "she keep changing her story). So I told here "I'm not doing this again..."I can't!" So as I began walking out of her business, I verbally asked her to deduct $55 from my credit balance...Today, 12/2/16, I calls and Sally answers, I identified myself and asked her once again how can we resolve this issue and can I make an appoint with To-Man today? I explain the total of $302 minus $55 once again. Than she states that To-Man is only willing to pay half. So I agreed and asked can I come in today to get service...She told me to come in around 8pm to discuss it...I told her "I'm not coming down there to discuss it, I want my nails and feet done...Sally went on a tangent, telling me she is done with this and there is nothing she will be doing because I came down to her shop being loud with her...I said ok! I can't do this once again with you...I'm going to file a complaint...which I should have done from the beginning! She hung up on me..

  • Someone called my phone from a attorney's office. I think they should have been calling the nail shop...they got contact info mixed-up...I didn't respond...lhd
