GEICO has turned over to their Subrogation Department who shall seek payment from NGIC for damages of $1,574. If they refuse, GEICO will then come after you for FULL PAYMENT of damages AND any expenses incurred. I suggest you give this matter your full undivided attention and govern yourself accordingly.
Obviously the solution is for Angel McDaniel to contact her insurance company right away. It is strange that she would allow a claim to go public like this because she refuses to do so.
All insured have a "duty to cooperate." Angel McDaniel isn't cooperating, which is somewhat to National General's advantage because if they can't investigate, well, they can't investigate and pay the claim as appropriate. But will she become a bad underwriting risk? I would think so. Insurance isn't my area, but my guess would be that failing to cooperate could lead to higher premiums and/or being dropped.
YOUR insurance company should be handling this for you. What are you paying premiums for if they can't handle a simple claim?
A couple of suggestions:
1) File a complaint against either or both insurance companies with your state insurance commissioner. You can call them before filing and ask for their recommendation about this.
2) If you have a large deductible and the damage is small, you may want to file against Angel McDaniel in Small Claims Court rather than going through your insurance.
Hopefully Ms. McDaniel is simply panicking about her premiums going up and will come to her senses and do the right thing. (It is normal to panic a bit if someone is young or has financial problems; at my age I've learned to be more forgiving than I used to be.) Her insurance company will investigate and then, it is what it is. But at least it won't be weighing on her conscience.
