Statement of Claim
Claimant says:
"We rented a property at 1341 W. Poplar St in York, PA 17404 from 14 May 2010 thru 9 May 2011 when we moved to South Carolina. Despite any and all efforts to maintain the property in a clean repectful manor and a glowing report from the owner; American Heritage has ignored any request for our security deposit, has tried bill us for damages that I have pictures showing were already there when we rented the house, and has referred us to a collection agency for the ridiculous amount of $2,044.00 of which we have paid $1,112.58 in order to try and preserve our credit while obtaining financing on our home here. Our rent was paid on time at all times and even though it was never disclosed that the basement flooded and we lost some major personal property, we continued cleaning and taking care of the premises, until 5 days before our lease expired."

Message from Claimant: Once again American Heritage has acted in bad faith. I cannot believe after looking at the photos and documentation I provided, you are continuing with your course of wrongfully action. I suppose I am going to have to take the further necessary steps to have this matter resolved.

  • I would have to agree with Yvette Cave in her findings on the Landlord, Tenant issues regarding proof of when the pictures were taken and with the fees allotted to the landlord or any dammages to the property. The only thing I would recommend is that you contact a lawyer or the local housing advocacy organization for the area and seek professional assistance to resolve your tenant/ landlord matter. You may want to seek professional legal counsel or assistance for further instruction or just to make inquiry regarding the tenant laws for the state to determine if hiring of legal counsel is required to rectify the matter. When contacting these organizations, please ensure to have all of your fact regarding the matter such as dates, receipts of any payments made along with names, contact information of the individual(s) or company(s). Also make a list of questions to ask and take notes incase you may need to follow up on any instruction they provide to you.

  • After doing some research, the landlord is obligated to have the security deposit returned to the tenant within thirty days of the rental property being surrendered to the landlord. The security deposit can be withheld in full only if damages incurred by the tenant and cleaning done by the landlord after the tenant has moved out exceeds the amount of the deposit. However, you said that you have proof by pictures that these damages were in fact there when you moved in. As long as you can prove dates of those pictures taken, there shouldn't be a problem. The landlord cannot withhold any part of the security deposit for normal wear and tear of any part of the property. Also, the landlord is required to give a DETAILED list of all cleaning done and damages noticed.
