Statement of Claim
Claimant says:
"American Document Preparation charged me $495.00 saying I was qualified for the HAMP program knowing full well I would be turned down due to the date I bought my home, my IRA accounts and that I was not behind on my payments. Bank of America turned me down for these reasons. ADP should have never taken my money when I did not have a chance to get a HAMP loan."

  • From the document I have it reveals that I was charged twice the amount that is normally charged to customers.

  • Actually we normally charge $795.00, we made an exception and discounted it twice to accomidate your financial situation because I see we only charged you $495.00. We dropped it to $595.00 then we made an exception in your particular case and reduced an additional $100.00 when attorney's charge minimum of $2,500.00 and they don't do any work until it's paid in full. Mrs. Campbell we provided you a document preparation service, not a guarantee of a modification because we are not your lender, attached is a copy of the signed document by you.

  • Mrs. Campbell the $297.50 you see is when we break the payment of $595.00 up in two payments of $297.50 to accomidate clients who need to split the payments up to help them financially afford the help, just as we did for you by only charging you $495.00. Mrs. Campbell what you need to do is re apply with your lender B of A because they are know for denying clients the first time but with the changes to the program and this being an election year the lenders are being held to a higher stander to modify existing loans and show why they deny you when you clearly qualify for the HAMP.

  • I had Bank of America re-evaluate my account and they still could not come up with a program I was illegible for. There was no way I was going to be illedgible for the program because my payments were on time and I have IRA's. You knew this and yet you conned me into paying you $495.00. If there was any chance I can see paying you the money but there wasnt. Until this gets resolved and I get reimbursed you will continue to hear from me on this issue.

The claimant's settlement terms were rejected with the following explanation:

    "Joanne Campbell hired Americand Document Preparation on 5/19/12 to help prepare her documents for a chance to take advantage of a government assistant program call HAMP which she qualified for under the guidelines, We have a signed document on file from Joanne Campbell where we clearly state to her that all we are is a document preparation company and we don't quarantee approval on any level and she signed it and returned it with a voided check agreeing to our terms for preparing her documents. We can't be held accountable for what her lender is doing to her, we sympathize tremendously because so many qualify but the lenders turn them down hoping clients don't reapply which is what Joanne Campbell needs to do in this case. She has a copy of all the documents and instead of being upset with American Document Preparation for providing her the service in which simply was preparing her documents she should be upset with her lender Bank of America who is known for trying to do this to their clients. The program has be revised as of June 1st 2012 and she should reapply with the copies she has from her last attempt, B of A plays hardball and everyone knows this but you can't give up and take your fustration out on us because you feel misteated by your lender. We clearly stated to you in the begining that we prepare documents for this particular program, we can't guarantee anything because we are not your LENDERS."

  • While the respondent does claim that they specifically have an agreement that does not guarantee a modification, they are in the business of preparing documentation with that goal in mind, and state that they are at least reviewing for potential prequalification. I would encourage the claimant to check out the website loanscamalert.org. Also, the claimant should contact her Attorney General’s office, to see if there is assistance available. In the meantime, if the claimant is not current on her mortgage due to this review for HAMP taking place, she should immediately get in contact with both her mortgage company and a HUD certified housing counselor who will assist her in the process of working out some form of modification or repayment plan to assist her in keeping her home.
