Only problem he has is dealing with his own issues . He blames everyone else and he knows right from wrong he don't care . See my husband does have issues but he knows right from wrong and he don't care . The courts control everything of his but he also use his disabilities to his own need . In 2005 we started living as husband and wife . He was always controlling I had set bed time no friends no family and for bid my own income in be it was my first time Tim r to Maui honeymoon vacation he called it . We always had more trouble when other people lived in house he started degrading me and blaming me for his issues . I'd love me to clarify that I'm the one who call his accountant Scott Christian told him that Alan has not gone to doctor in like 2 to 3 Years I'm the one who set that ride up to get him to doctors appointments if it wasn't easy for u to go he would not go slot was blamed on me in Westword story that was not true and i didn't keep.him for I'm going he just didn't want to go after he let people move in he was aftraid he would miss something . And as for the part if me leaving several times a day it was because he would kick me out 7 to 20 times a day then I get a block or so away he would want me to come back . I had nothing at all he started to hold his money over my head saying g I wouldn't get this or vihfs it pay m to cell phone bill. Be and one by morning I was eok up to his hands around my neck because it was day after july4 the money when money went on Kaye because of that how could a wife give in to sex when he would belittle me and tell and degrade me even in public . By that time I had moved into other bed room . I would get on my knees crying he would threaten to move in another girl I had given in to him many many times I would say u know why I'm in that room . Tell me why he would get violent and start swinging fist . Scot knows he lies because Stacey kennadey was in vasebt living when he was told moire people in house he stood right there and lied to his face several times. Without being privy to all the details of this case, I would agree with Mr. Maxwell. I seriously doubt that there is any legal obligation to share the millions "earned" through a settlement. However, there is certainly a moral obligation to help a long-term partner. As someone who all too frequently sees men behaving badly, I am happy to see that the two men who have commented on this have both said as much.
I agree with both that short-term support is the only ethical solution. To be brutally frank, I would also agree that it should be in a form that can't be squandered, i.e. it should be in the form of pre-paid rent etc.
The name Alan Fantin seemed familiar and a quick Google revealed why - the story of the "Homeless Millionaire." I have now re-read the story in Westword and read through the complaint.
Essentially, Devota Quinn is asking for a settlement as a common-law wife. I am not up on current Colorado law, but I don't believe that she is legally entitled to any part of Alan Fantin's $3 millions since it was "earned" via a legal settlement for injuries suffered prior to the common law marriage.
That said, "the law is an ass" - as memorably noted by Charles Dickens. What is legal is not always the same as what is right.
In this case, Devota Quinn appears to have helped Alan Fantin in many areas of his life before the relationship turned into a hot mess - by cooking for him, getting him to the doctor, etc. According to the Westword story, she took the place of his companion. There's a whole lot of he-said-she-said in the story, the complaint, and the allegations of domestic violence. (The stories do not reveal the outcome of the court case about the abuse.)
However, to me it boils down to this: Ms. Quinn lived with him and did not work (she says she was not allowed by Alan Fantin to work) for some 12 years. She is morally, if not legally, entitled to a little money to help her get back on her feet. In fact I believe it is shameful that Mr. Fantin and his advisors have not made some kind of settlement already.
As Mr. Fantin says very clearly, he is living off the income of the settlement and not touching the principal, but he does not expect to live a long life due to the seizures and his other health issues. I am of course curious to know where the roughtly $3 million in principal, so assiduously conserved by his protectors, will go once he does die, since so many people appear to be invested in his not being able to touch it. However, just as it seems reasonable to me that he should be able to cash in a little of the principal and live in a house that has been cleared of black mold and squatters - and go to Hawaii, or watch porn - it also seems reasonable and necessary to me that he should be able to cash in a little principal to fulfill his ethical obligations.
Ms. Quinn is asking for $10,000, and this seems reasonable to me. I would recommend that Alan Fantin and his advisors settle enough on her to prepay rent and living expenses for six months and also undergo some type of vocational training so that she can work and support herself in the future.
