The claimant's settlement terms were rejected with the following explanation:

    "Mr. McConnell:
    AAGI originally replaced your transmission on your 1999 Mercedes Benz under your Wheelz Contract in March, 2010. When the replacement transmission failed in October, 2010, it was also replaced. However, the current transmission problem did not result from a defect within the transmission itself. Rather, the inspection report established that the radiator’s automatic transmission fluid cooler, which is an integral part of the radiator and cools the transmission fluid, failed. This failure of the radiator’s automatic transmission fluid cooler allowed water to enter the transmission, and continued operation of the vehicle caused the transmission to breakdown.
    You selected Powertrain Plus coverage. Under your Wheelz Contract, Powertrain Plus only covers listed parts, and the radiator is not a listed part. Also, under the Exclusion Section a breakdown caused by water or water intrusion is not covered, and damage to a covered part (the transmission) caused by a non-covered part (the radiator) is not covered.
    Respectfully, AAGI believes that the denial of your transmission claim was proper under your Wheelz Contract. We would like to point out that in addition to previously covering your transmission, AAGI also paid for repairs to your rear differential, and has paid over $3200 in repair benefits.
