Statement of Claim
Claimant says:
"Insurance Co. has covered some damage regarding hurricane Irma but given very little toward roof repairs. Six roofers have looked at the roof. All have told me that I need a completely new roof. I also have ceiling damage where water came in. The adjuster stated that the ceiling damage was due to rain blown in plus he couldn't find a hole in the roof. My roofer found the hole and did a temporary patch. We did not have a leak before the storm but water has come in since when it rains. He also stated that there was faulty roof repairs in the past. I have owned the house since 2000 and have replaced three tiles which blew off in a previous storm. Other than that I have not had to make any roof repairs. I am short around $60,000 plus the ceiling repair."

  • Insurance company claims that they could not find a hole in the roof. The roofing company found a hole. Since the roof claim was denied so was the ceiling repair. There was no leak prior to Irma. The ceiling has leaked now every time it rains. Insurance company reported that there were sloppy repairs done in the past. We have owned the house since 2000. The only repair that we have done is to replace three tiles.

"I have some concerns with a couple things

If the hole in the roof was found and repaired why is the roof still leaking?

Insurance said there were past sloppy repairs..what were they and who specifically has the expertise to determine if such repairs were sub par? I would ask to see the basis they used to make such a determination.

Who replaced the prior windblown shingles? Was an adjuster or roofing professional ever on the roof prior to Irma? Prior sloppy repairs should have been evident at that time. I have a hard time believing wither would only look at 1 section of a roof and ignore a cursory glance at least, of the rest.

It seems to me that interior leakage age is in question. If the adjuster sees old repairs as the problem there should be a professional with experience in say, drywall that could come in and give a report on what he/she sees as to weather the damages appear to be prior in age to Irma.

Its hard to understand why an insurance company would deny a structural claim after a clear storm event.

It's also very hard to envision a 61000.00 roof. One hole does not a total roof repair make.

As with most contracts there may be an opportunity for arbitration and may be a step to take for both parties. Perhaps a third party certified roof inspector can be hired to assess the damages and cause(s) binding both parties to his/her determination of fault and extent of liability for one or
both parties."

"We purchased the property in 2000. The seller stated on a disclosure form that the roof was about two years old at that time. Other than reattaching three tiles from a previous storm no work has been done to the roof. We pressure wash it every other year as required by the association. In between the two inspections by the insurance company we hired a roofing company to patch the hole. The first attempt failed so they went back a second time, found the hole and patched. This seemed to work. Some tiles were disturbed while searching for the hole. The hole could possibly be caused by the solar system being ripped from the roof during Irma. The new roof is being installed currently. Besides the hole many tiles were lifted by the storm.
At this point I think that mediation should wait until the new roof is finished and the ceiling repaired. Then we will have a total cost for the damage."
