Statement of Claim
Claimant says:
"I brought in my Pomeranian Milo to be groomed. This is not the first time I have brought him in to be groomed and specifically told Jenny (the groomer) not to shave him with clippers on his body but only in his fanny area. She said he was matted which I acknowledged but said I did not want him to be shaved. Upon grooming him Jenny took it upon herself to shave him to the bare skin without my consent. She had my phone number in which she could have reached me to consult but did not do so. When I saw my dog after my husband picked him up from Bayou Pets I was shocked and upset because she did the exact opposite. I called to speak to the manager Bryan who said to me, "I only collect the money. You will need to speak to Jenny. I called and spoke to Jenny and while explaining that my Pom no longer looks like a Pomeranian and is acting differently by hiding and not wanting to eat or play, she started laughing. It was amusing to her when I stated my dog was not looking or acting the same. Finally she hung up without an apology or acknowledging she was wrong. As a result of Jenny shaving my dog to the skin he now has a skin rash with razor bumps and redness on his skin."

  • Evelyn Sarabia first appointment ever at Bayou Pets was on Feb. 29,2012. Her next appoinment was Oct. 2,2012(8 months later). She then made an appointment for June 25, 2013 which she never showed up for(I was nice enough to not make her pay the no show or no call fee). The day of Jan. 7,2014 was the next time I saw her dogs and you can imagine the condition of their coats(a year and 2 months later). As we brought the dogs into the shop I physically showed her where Melo was matted(his entire rear end-on further inspection also matted all around his neck) and said that it would have to be shaved. She said, "Ok I know I need to start bringing them in more often". At that point of her saying ok there was no further need for me to contact her past that because she had already authorized the groom. If she had told me to only do just a face feet fanny groom on him and to leave the matts on his body I would have given her one of two options: 1 shave the dog 2 take the dog home. I would never bathe a dog with the condition of her dogs coat and just leave the matts due to the fact that wetting the dog only makes the matts worse and tighter(plus I would never put my name on that kind of work). She also stated that he has razor burn on his body but with the thick undercoat as tight as it was to the skin that could also cause the skin to be red and irritated. Had I have brushed the undercoat out his skin would have been much more red and irritated and sore to the touch. She stated to Janet that he was bleeding from his anus but it was due to the fact of lots of dried feces stuck to his rear end and I had to use my fingernails to remove it and it had scabs underneath the hard dried feces. I even left some of it so that it wouldn't leave open sores. Point blank if she doesn't care for the well being of her own dogs more then to bring them in only once every year and two months then she can only have the option of her dog being shaved, however I did inform her in person and she said ok. Otherwise I would never had shaved him! Also I did not hang up on her, after going round and round getting no where explaining the same details to her for 15 minutes(according the the time counter on the phone) i put her on mute to discuss with Brian as to what i should do at this point. I noticed it was quite on the phone so i unmuted it and said hello but the only thing on the other end was a busy signal(I assumed we got disconnected). I could have called her back but if she hadnt understood what i was saying in 15 minutes then she wasn't going to.

The claimant's settlement terms were rejected with the following explanation:
  • "Mrs. Sarabia fails to mention in this claim her other dog Taz a Yorkshire Terrier that has to be shaved every time they came in. I am told by her I already know his condition so go ahead and shave him. Now why would one dog be so matted that she tells me to shave him but the other dog would not be in the same condition? She will get no money back but I would strongly recommend from this point forward that she shows a lot more concern for the well being of BOTH her dogs!"
