Statement of Claim
Claimant says:
"They do not want to fix my car. I bought this warranty from wheelz and certain parts were marked on my declaration page and now they don't want to cover it because they said in another part of my warranty it states if there is carbon on the engine then it's not covered. My car has been at brown and brown( the mechanics) since February and they said there is carbon on all engines. Also before we did anything to the car at brown and brown we called wheelz and told them what was wrong and wheelz said that we had to take out the engine so they could send an inspector out to look at the car. Now they won't cover anything. To take the engine out was $2500 plus I have been making my car payment on time since February of $365.00 and I can't even drive my car. Now my car has been sitting so long with the engine out that brown and brown said I need a whole new engine which is like $5000. I'm am out so much money and I just want my car back. I even tried to cancel the warranty but the stated there was no money to give back. I would have never took out my engine if I knew wheelz was not going to cover fixing my car because it did run before I brought it to brown and brown and now it doesnt."

  • Our records indicate that Amy from Brown and Brown Chevrolet contacted American Auto Guardian Inc. (“AAGI”) on February 25, 2014 because Ms. Becker’s 2005 GMC Envoy was consuming oil. AAGI advised the repair facility to obtain Ms. Becker’s authorization to tear down the engine so that the problem could be uncovered, and then to call back when it was ready for inspection. Paragraph 5 of the Section entitled “Instructions in the Event of Breakdown” of Ms. Becker’s Wheelz Vehicle Service Contract provides:

    In some cases, You may need to authorize the repair facility to inspect and/or tear down the Vehicle in order to diagnose the failure and determine the cost of the repair. You will be asked to sign the repair order and be responsible for these charges if the failure is not covered under this Contract. Our Administrator reserves the right to require an inspection of the Vehicle prior to any repairs being performed.

    AAGI sent an independent inspector to determine the cause of the oil consumption. The inspector found that the #1 piston oil control ring was seized in the piston due to carbon buildup.

    Ms. Becker’s Wheelz Vehicle Service Contract provides, in Exclusion No. 26, that a breakdown due to carbon buildup is excluded from coverage. Accordingly, AAGI believes that Ms. Becker’s engine claim is not covered under the express terms of her Wheelz Contract.

    Wheelz also ripped me off due to their fine print Exclusions. I am out $1971.00 due to their fine print which they call Exclusions. They tried to tell me that engine Coolant (antifreeze) is a Lubricant and therefore, my Heater Core which was clogged with hard as concrete sediment and impossible to flush out was not covered. What a Pathetic excuse.
