Claimant says:
"A contract was sold to me for Solar energy. I was informed my the salesman that is was a win win situation. That I would save a lot of money. There is no charge for the solar panels.
I was not informed the contract was for twenty years and if I sell my home the contract has to be sold at that time or I would be responsible for this.
I am 90 years old no one was with me on my behalf when the salesman came back to fill out the contract.
The sales did not do a cost study of what I was paying SCE.
I am now paying Vivint Solar one and half times as I was paying SCE. I still have to pay SCE to be on the grid.
My niece called and left a lot of messages, no one returned the calls.
We finally made contact with someone in the solutions department. His reply was that they have a signed contract and would not cancel this contract."

The claimant's settlement terms were rejected with the following explanation:
  • I disagree with the explanation / grounds provided

    "We are troubled by Ms. Stewart's allegations in regards to Mr. Kincaid, however, we are weary because Ms. Stewart has represented herself both as Mr. Kincaid's niece and daughter at different times to different customer service agents.

    We have tried to reach out to Mr. Kincaid in attempt to resolve his concern. We have not be able to personally speak with Mr. Kincaid.

    As stated in our previous response, Mr. Kincaid is saving money with Vivint Solar and had built up a credit with SCE thus far that he can use in the winter months when the panels do not produce as much.

    Vivint Solar is dedicated to treating customers fairly and resolving concerns. We will continue to try and contact Mr. Kincaid to resolve his concerns. "
