Statement of Claim
Claimant says:
"I purchased an air conditioner from the company three months ago and have had to call them out twice for service. The first time the evaporator pump on the furnace failed and they replaced it. This last time they came out and said that the condenser needed to be replaced and that the fault is mine because I used a wrap around filter on it to protect it from debris. They claim that the use of the filter constituted a modification of the system and that voided the warrantee. The want me to pay for repairs to the unit. I checked with an HVAC specialist on Just Ask and explained my problem. His response was that the filter I used would not restrict air flow to the unit to a degree that would cause the problem I was told I had. In fact in his opinion the filter would not harm the unit at all. The new pump was leaking water on the basement floor again and when I mentioned this to the company they said that was a separate issue from the original one. I am not an HVAC specialist but I do know that I paid $2800. for a furnace and I should get more than two months of service from it. The company that supplies the filters is Permatron. They manufacture the "Protect Wrap Around Air Conditioner Condenser Filters. I have scoured the internet looking to find negative reviews from the filters users and found only high praise for the item. I do not think that using a filter that in no way alters the unit should void the manufactures warrantee or relieve the company from their obligation to fulfill their original agreement to provide warrantee services.

Ellen the company rep said that if I was going to file a complaint after paying the $500. she would not allow the techs to repair the unit. I could not agree with her stance even though my husband is ill and the summer heat is not good for him. We need the air conditioner and I will have to get it repaired. I agreed to pay to repair it and settle the warrantee issue later. She now refuses to fix the unit at all. She said she did not want to deal with any litigation.

It is my opinion that the unit was faulty to begin with and the filter is just an excuse to shirk responsibility. There is no modification to the system and so the warrantee should be honored."

  • Because my attempts to pay you have failed. I now ask that you honor our original agreement and repair the air conditioner under the present warrantee. I ask that you replace the part that Carrier has provided and return the unit in good working order. At the time of delivery of the air conditioner I will pay the agreed upon $400.00 payment for the service. I will not sign another contract. The one I have signed is still in force.
