Claimant says:
"I got in touch with Stephen Travis in early March 2011, and dicussed the problem I was having with my mortgage interest rate. Which at present I'm paying 9/25%. The only thing he was suppose to do is get me home modification loan at a lower interest rate. Mr. Travis told me not to worry because he has done hundreds of modifications of this type. Then he told me what his fees were. A one time payment of $795.00. I then instructed him to go ahead and make the deal at that price. Mr. Travis sent me the payment instructions by E-Mail. I then completed the forms and sent them back to him by fax. This is when he took $795.00 from my credit card account. I would then call Mr. Travis about once every two weeks to check on things. The last time I talked to him was the middle of June (I think). That the last I heard from him. I have sent numerous e-mails and made several phone calls, and the only thing I got was his answering machine with his wife stating that Mr. Travis will be out of town until futher notice."

The claimant's settlement terms were rejected with the following explanation:
  • I disagree with the explanation / grounds provided

    "Mr. DeLeon did not disclose that he had already been in a trial modification but failed to make payments in a timely matter when he hired us to prepare his paperwork. According to the contract our responsibility is to prepare paperwork for the modification and provide education. Because he had failed to make his payments he was not eligible through his bank. We would have not taken his case if we would have been informed of this upfront. The bank required him to wait six months before resubmitting. We resubmitted his paperwork on his behalf without requiring him to pay an additional resubmit fee which is stipulated in his contract."
