Statement of Claim
Claimant says:
"In 2010 I bought a car from Tate Branch Dodge in artesia. It was not as is and I assumed it had a warranty because it did not state otherwise. Upon purchasing the vehicle the inside was not clean. There was hair make up sunglasses and dirt. After a month they called because the 'forgot' to get the vin # for my plates. From the first week I noticed the brakes pulsated and the a/c fan was sounding weird. After 7 attempts to get the brakes done and a year later they finally did replace the brakes. That's after me calling over and over after leaving many messages. I repeatedly asked for my fan to be looked at and all " Dwayne" the service guy did was bang on it with his hand and told me there it's fixed. Before a trip to Texas I had the oil changed and asked for my fluids and tires to be inspected. They checked off everything stating it eas fine. I had a blow out in tx on the highway and almost flipped. 2 of my tires were dry rotted after they told me they put new tires prior to
buying the car. My fan recently gave out and my car overheated. A mechanic from the dealership was riding with me to drive my car back to get serviced because its
my only vehicle. I pulled over freaking out and asked the tate branch mechanic " what do I do!" His reply was " I don't know. I don't know much about cars!".My coolant was boiling. They told me it'd be 3 days until anyone could see it and no guarantee I could get it fixed. I was also told I could not get a loaner. I am a
pregnant single mother with no choice to drive in 108 degree weather with no a/c.
They also call me apparently I had an extended warranty that I paid 2,000 dollars
for that to my understanding was up to 100,000 miles. I bought the car with 70,000
miles. Now 30,000 miles later they told me it's expired. I had to pay a mechanic on
the side to fix it and it was 800 dollars. To make things worse I told the service men
in parts and service i did not want a specific employee drving my car or looking at
my car for past reasons and he now knows where I live because he delivered my
car! ! Not to mention I took it initially for an oil change and my oil is still black and my change oil light still comes on. Needless to say it was a mess up on the part of the Service men because they never brought me an invoice to pay for the oil change and I will not pay for being treated this way. It's the worst dealership ever."

    "Annel Gonzales purchased a 2004 Chev Impala on 01/17/2011 with 83,671 miles. She did sign the Government As-Is with the Implied Warranty (15 Days/500 mile in New Mexico). She also purchase a 2 year 24,000 mile Standard Coverage Service Contract which would expire on 01/21/2011 or 107,671 miles, which ever comes first. If she would like to come in and talk to Tate about this situation, that would be welcomed! "
