Statement of Claim
Claimant says:
"I bought 3 home warranties from Stanley which had a 30 waiting period and after 10 days I had not received a copy of the contract, so I contacted them. The Stanley home warranty representative was NASTY when I said I never received a copy of the contract, so I elected to cancel. I called numerous times to try find out how to cancel my policies since I did not have any documents, but it was always the same thing someone will call me back but I would never receive a reply from them, until finally someone gave me a fax number. I faxed the cancellation and later received a phone call from Liz from Stanley asking that I change my min and keep the policies. I have a photo of the caller ID when Stanley called me back asking that I change my mind. I said no and faxed another cancellation notice also putting the charge in suspend with my credit card co. To this day I have never received any documents from Stanley. When I received the documents from my credit card company I could see that Stanley had the wrong contact information so I called this incorrect information to my credit card co letting them know that Stanley has the wrong contact information. My credit card company relayed this information to Stanley, so Stanley then changed the documents to look as though they sent the documents to the correct e-mail address and resent these documents to my credit card co claiming that they had sent the documents to the correct address, but when they changed the documents they forgot to change the account info page to reflect the changes they made on the other documents. So they were still showing the incorrect contact information. Stanley then claimed I never sent them any cancellation notices even though I have calls on my phone bill, which they now say was the wrong number, I also have the history on my fax machine displaying the 800 number which is the number that is on their contract and an e-mail where they replied to my cancellation. Stanley knows that 800 numbers can not be tracked by my phone bill, so they figured I had no proof, forgetting the history that is stored on my fax machine. Stanley does not reply to any phone calls, they don't reply to my e-mails or faxes, their legal department won't reply either. They know what to do, so I am sure I am not the first person they have done this to. The person who helps take care of my property also saw me fax Stanley the cancellation notices, yet I can not get a refund from them"
