Statement of Claim
Claimant says:
"Briefly explain your problem In March, 2013, I hired Romy and Jacob to produce products for my small business under their private label service. I first contacted them through an industry trade site, and they made many promises and assurances about their experience in manufacturing, and told me all about their factories, saying my products would be partially made in their Montreal factory, then sent to their NJ factory to be completed.

As it turns out, no such factories exist.

Lina Asselien was not only my rep, but an owner and major shareholder of Romy and Jacob, Inc and also Canilux Group Ltd, and also RJ Distributions.

So, after scouring the internet for any negative reviews or records of lawsuits, all seemed to be in the clear, and I was already familiar with their brand.

Romy and Jacob told me (and they claim this on their web site as well) that they personally own their manufacturing facilities, and personally produce the products for the client. All over the web, you can see various business addresses posted in their listings which are said to be their offices, factory, and so on.

When five months had passed, and they hadn't even shown me photos of my samples, much less completed one round of samples for my products, were attempting to charge me for items I never even asked to be made, and violated their contract in every possible way, I hired an attorney.

Upon some checking, I found that each and every business address provided by Romy and Jacob on all of those very public web sites turned out to be apartments. Private homes. All residential buildings, none of them commercial or industrial.

Further checking revealed that an image they have since removed (when they were called on it) on their web site of a factory they claimed to be their "12,000 sq ft factory in upstate NY" actually belongs to Bergamo Clothing company, which makes specialty athletic wear for cyclists, and has nothing at all to do with Romy and Jacob.

Is it a little odd that someone who owns a factory would steal images of someone else's factory instead of using their own? I think so!

Every day, it seemed I was uncovering something new and alarming about this company I paid so much money to with the agreement that my products would be made.

Romy and Jacob refused to take any form of payment other than a wire transfer, which I admit is dicey, but because on the surface, I had seen no red flags, and because I made the payment through my own bank, I was willing to give them a chance.

Under false pretenses, they took $14,000 from me, and even though they absolutely did not deliver on any of their services or complete a single sample, much less a product..they refuse to return my money.

They refuse to mediate, and when they finally decided maybe they should hire a lawyer to write a letter, of course they never acknowledged the $14,000 they owe me.

I even met my rep at a recent industry trade show, and though I was having serious doubts (this was July) I still continued to give her a chance to show me that she was legitimately doing what she'd promised to in our contract and in all those many e mails and phone calls. She had no problem stabbing me in the consumer back the moment I returned home from that trip though, attempting to charge me nearly $4,000 MORE for products she'd failed to even show me photos of.

Yet claimed to be producing. The photos eventually shown to me consisted of 1-2 pieces of each style, badly done, and very incomplete. This is what took them five months and $14,000 to come up with? When they kept demanding more money, I finally realized they had not been making anything, and it was just a scam.

Now, she claims I asked for lots of changes which is why things were taking so long.

Changes. On items I'd never even seen photos of. On samples they'd never actually completed.

That goes far and beyond outrageous or dishonest and right into fraud as far as I'm concerned.

They were very upset that I posted complaints on sites dedicated to consumer rights and protection, and claimed it was illegal. Obviously, it's perfectly legal, and I am fully within my rights to use such forums.

Apparently, they've confused "illegal" for "Stuff we don't want people to know about us".

Their position seems to be that they took money, failed to provide one iota of service, and get to just keep it anyway. If anyone dares complain, they threaten them.

If my report saves even one person from losing thousands of dollars when they are only trying to launch their own brand and start a business, then I will have succeeded.

They clearly do not care about their reputation or they wouldn't be lying to people just to get their business, then failing to deliver the services and goods once they do have the person's money.

Further, if they were a legitimate business, they would never allow a dispute with a client to escalate to such a point that the person was left with no other recourse than to communicate with consumer organizations.

I have also notified the Internet Crimes department, the BBB fraud division, and other consumer agencies, all to no avail so far. They just don't care about their reputation as much as they care about stealing people's money, I guess.

  • Here is a screen shot from before they removed the image of Bergamo Clothing's factory, passing it off as their own. On the photos, you can see the words 'pez cycling news'. They probably thought no one would look that up, but someone did. That factory belongs to an athletic wear company, and if you look closely, you will indeed see those workers are making bicycle jerseys. Not dog clothes. Bergamo Clothing has no relation to Romy and Jacob. They just stole the image to assist in their scam. They needed people to believe they owned a factory, so they would hand over money for manufacturing.

    Very very deceptive and shady tactics.

    I have been forwarded an e mail where Lina Asselien is making false accusations and attacking me personally. Pretty incredible of her! She lies, takes money under false pretenses, delivers on nothing, then has the nerve to pretend she is the injured party?

    As for the personal attacks/false statements..I've come to expect nothing more from her.

    That's just her professionalism on display.

  • Rachel Chappel has contacted numerous online forums and posted false allegations about this work contract. We are THANKFUL to the outlets who have taken the time to personally contact us at our head office to obtain clear facts before posting Mrs. Chappell’s wrongful account of the events.

    Rachel Chappell contacted and contracted Romy & Jacob inc. to design, develop and produce original work towards a pet apparel line in March of 2013. She paid a retainer for this work. This work commenced upon work order signature and was a FRUITFUL AND PLEASANT WORK COLLABORATION throughout the months. Handfuls of emails were sent to us by the client between March and August expressing satisfaction with our firm’s work (see enclosed examples).

    Rachel Chappell states product samples were NEVER sent to her: samples WERE sent to her and this was confirmed by her to our company by email.

    It is to be noted that samples, fabrics, trimmings, etc. WERE SENT to Rachel Chappell by mail throughout the months, with receipt confirmations by email by Rachel Chappell each time.

    Romy & Jacob inc. has NEVER solicited Mrs. Chappell for any funds or monies. MRS. CHAPPEL CONTRACTED our company to undertake a voluminous design & development project for her line of pet apparel. The quote submitted was standard and based on work labor hours, development fees, design fees, samples development, etc. THE CLIENT SIGNED A WORK ORDER INVOICE, paid the appropriate retainer and instructed our firm to commence work immediately. The work order specified that additional work or request from client are at the client’s full charge.

    The retainer for this project was $14,000, as approved by the client. Romy & Jacob inc. doesn not process amounts of this size on credit cards, out of safety for their operations. Cheques and / or wire transfers are requested for transactions about $2,500.

    SERVICES HAVE BEEN FULLY RENDERED on this project and we await a response from Mrs. Chappell’s lawyer as to what arrangements to take to assist the client in closing her file with our company.

    Romy & Jacob inc. was founded in 2005, in Montreal, Quebec, Canada by 3 entrepreneurs. The current business address is public and duly noted on all customer invoices and communications and is located at 5455 de Gaspe, Montreal, Quebec, Canada. The company’s manufacturing is done in this facility, under their governmental grant agreements. The company is regularly visited by their government representatives and continues to receive government funding for their operations in Montreal. All private-label contracts are manufactured in this Montreal facility and have been since they took possession of this rental space in 2006.


    Mrs. Rachel Chappell may have found listings not yet updated for Romy & Jacob inc. that show the business still being located at the original incorporation address, but has never made asked our company representatives about this situation before or during the work relationship. Mrs. Chappell was invited to visit our head office on numerous occasions since the contract start date.

    On August 2nd, after meeting our company rep at a national trade show in Vegas, Rachel Chappell suddenly began questioning the company, our location, our work and asked for an immediate refund on original work we had produced for her and that SHE HAD CONTINUOUSLY APPROVED DURING THE PAST MONTHS (always approved in writing, with comments indicating our company was doing a great job and that we were delivering as she had asked.).

    MRS. RACHEL CHAPPELL DECIDED TO CHANGE DIRECTION IN A MATTER OF DAYS AND EXPECTS OUR COMPANY TO REFUND THE 5 MONTHS OF WORK SHE ACTIVELY COLLABORATED ON, APPROVED AND PAID A RETAINER FOR.

    The client began questioning our practices on Friday August 2nd after business hours. We HAVE NOT had a chance to mediate or discuss with the client to date, as they proceeded to post their concerns on the internet during that weekend. Come Monday AM, August 5th, we had no other option but to contact legal council, as the client had posted dozens of posts and emailed threats to us and our staff DURING THE WEEKEND. Again, we have not even had an opportunity to discuss with the client the final invoice, shipment or to take any arrangements whatsoever.

    The client states they have tried to mediate, negotiate or get information from us, but they have not done anything but post this litigation on public websites in hopes we would respond, which we refrain from doing. Romy & Jacob inc. will not respond to this file on ANY public portal and has advised Rachel Chappell that we are HAPPY TO MEDIATE THE SITUATION THROUGH AN APPOINTED LAWYER ONLY.


    Rachel Chappell (Shiloh's Dog Boutique) has only been invoiced for what the company has delivered thus far and for what she has agreed to upon signing contract in March. No other fees are being requested from client at this time. These charges include full product development and original design work stages for 6 original products only. No other products are currently being developed or charged, such as alleged collars, which were removed from invoice in June as per discussions with the client.

    The client falsely informed our company that we could work out a delivery agreement with an assigned lawyer after she started expressing concerns in early August. Our company received ONE INITIAL LETTER from this lawyer, but NEVER HEARD FROM HIM AGAIN. We have made efforts to contact this lawyer to make immediate project delivery arrangements, but both our letters of August 13th and August 19th remain unanswered.

    We do not think Mrs. Chappell is truly working with this appointed lawyer as she continues to post her concerns on the internet, giving us indication that she does not have access to legal council and has lied to us about this.

    The client has admitted to Mrs. Asselien during a pet industry event in July that she is under the influence of numerous prescription drugs, including pain killers, some from illegal sources. We feel the client is not stable and making ill-advised actions. We have yet to offer any settlement in the matter, as we are confronted with the numerous threats received in our offices by email.

    Romy & Jacob inc. will not respond to this file on ANY public portal and has advised Rachel Chappell that we are happy to mediate the situation through an appointed lawyer only. As well, because of the elevation of threats and harassment received by email, our company has referred the file to proper authorities in Rachel Chappell’s county in California, through the remote FBI office located in Montreal. All emails and postings now being monitored, we reiterate the importance of working through an appointed lawyer to resolve this matter.

  • Lina Asselien is the only owner of Romy and Jacob. Public records show this. she most certainly did not do any work whatsoever on anything she agreed upon. It makes sense once you realize she does not own a factory, much less two as she claims.

    My lawyer feels she has violated the RICO statute, which of course can be used as a civil and/or criminal complaint against someone, and we have sent them a letter demanding payment, due in three days from now. A lawsuit will be filed in Federal Civil court utilizing the treaties in place between the USA and Canada. Attorney has every single e mail, and we've also been in contact with a party who knows Lina Asselien personally, who has given a signed statement verifying that Romy and Jacob is only Lina Asselien.

    They do NOT do the massive volume of business she claims. They do not own factories. As such, any claim on their part that they've done any sort of manufacturing work is fraudulent.

    Lina Asselien has yet to make even one truthful statement, and even uses imaginary people to respond on her behalf. "Libby Waltz" does not exist, and this was confirmed not only through records checks, but by a party who knows Lina personally. She said she has 'always stolen images to use on her site" and "Always uses fake names".

    Indeed.

    I have every correspondence saved, and she seems to have violated the law.

    The false information she just posted will be handed over to my Attorney and become part of the case records.

    I am Grateful she's still willing to openly lie, as it strengthens our case.

  • Additionally..Lina's "Proof" is exactly what I'm stating. They sent me fabric swatches. That's it. I was never invited to 'visit their headquarters" I live in California and they are in Montreal, so this is ludicrous at BEST.

    Further, Lina Asselien and her lawyer have been notified that we are filing a lawsuit should they fail to return the money they've stolen three days from now (They had 10 days total to do so).

    I have never, ever gotten completed samples, and in fact, was never even shown photos of partially completed samples until July 20th 2013.

    I met Lina personally at a trade show in July, and she was the only vendor there who refused to sell anything. Why? She had limited inventory, she said.

    Interesting for an alleged factory owner, who claims to do millions a year in sales, with '3,000 retail points worldwide" is it not? She couldn't sell a few sweaters at a huge trade show event for fear of not having enough inventory?

    She also lied even about her husband. She claimed he was a psychiatrist, he actually works in IT and has almost as many failed businesses as she does.

    "Canilux" is the business name she used on top of the invoices she sent me. Quebec's registrar confirms she has not paid licensing fees in years, hence this business does not even legally exist.

    Fraud, plain and simple.

    Romy and Jacob/Lina Asselien do NOT produce products. Chinese factories do.

    She does not even have employees other than 1-2 which are frequently changing, according to a source, because "She never pays them".

    She fraudulently misrepresented herself (and continues to) and has done nothing BUT lie to make her company appear to be something it is not.

    Several global trading sites have since banned her, finding that she was indeed fraudulent.

    Violating the RICO statute, racketeering, wire fraud..these are serious issues.

    She'll probably realize it too late, when she's facing a judge.

    Again, I'm pleased to see she is still airing those lies and playing her games for all the world to know. It's the Attorney and judge who this benefits, not Lina Asselien.
