Statement of Claim
Claimant says:
"On 2/6/14, I visted the outpatient pavalion for some pre-op bloodwork, EKG, and a chest X-ray. During the blood draw, the nurse (who did not have my arm elevated) put my vials on the pull out extender portion of the patient table. She bumped the table, almost knocking the vials of blood onto the floor, and moved the needle in my arm. I said "ouch" and she immediately removed the needle and said "well you're all done anyway". I felt a pinch, but did not feel so bad yet, so I went on to my chest x ray. By the time I had walked down the hall, my left forarm was so swollen I couldnt even bend it to get my own bra unhooked. I asked the xray tech if it looked unusual, she said I had to go back to the nurse who drew the blood. When I went back, the nurse refused to admit anything was wrong, even though it was evident to me by then that she had pushed the needle through the vein walls and nicked an artery...bc my whole forearm was in pain and very swollen and beginning to bruise. She gave me an ice pack, and said the P.A. would take a look at it. When the P.A. came in, she said the nurse had to fill out an incident report(which I have requeated several times and not recieved) and I had to walk down to the E.R. just to have it checked out. I asked if I had to, because I did not want to get hit with an ER bill, and they said I did bc of the report. so I went, where the doctor gave me an ibuprofen (which I wasnt supposed to have since I was having surgery) and sent me on my way...everyone involved assuring me I wouldnt be billed. Of course I was, and not only that, but I missed several days of work because of the injury to my left arm. i work as an exercise therapist, and my boss said he could not have me working with my arm like that, since i was discharged with "phlebitis". The nurse refused to acknowledge she was negligent or made a mistake. i have called 5 separate times, spoken to several supervisors named Veronica, Nikki, and Gabby M., they told me they would take care of it or send it on to a patient advocate and I would hear from them the next business day. That was two weeks ago. i want my bill dropped, and I want reimbursment for my missed work and wasted time trying to handle this situation. When i went back to Riddle for my surgery on 2/24/14, my surgeon, Dr. Rihn, asked if i had an incident during my pre-op work and if I had "been faint" during my blood draw. That was not even close to what occured, I was never faint, and I believe the nurse lied on the incident report. I have pictures of my arm which took several weeks to heal, and documentation of the phone calls I attempted to resolve this issue. i also called my insurance company twice, and they said I had to resolve it with the hospital."
