Statement of Claim
Claimant says:
"I bought a pool from Gary pools and was given a few phone numbers to choose from to install the pool. I chose Rich pools. They installed my pool on June 8th, 2014. They arrived at 8:30 A.M. and started digging for the pool. While digging they hit a gas line that was connected to my garage. It was bent and still stuck in the ground. They also hit an underground electrical line going to my garage which cut the power to my garage. One of the workers came to the door and asked why he couldn't get any power from the garage. My response was; "there was power this morning, and I don't know why there is no power now." So he asked if he could run his line into my hallway to get electric. (which I did for him) When the guys were just about done, I went to see the finished product. Much to my surprise, there were 2 pieces of pipe sticking out of the ground (one on each side of the pool) I asked what it was! I was told they hit a gas line, but don't worry they put duct tape on the end to stop the gas from coming out! I immediately called the Gas Company! They came out and shut the gas off going to that line that was exposed. I was told that I have to call a plumber and get a new line installed.(at my cost, unless I could work out something with the pool installers, as they did the damage) I had to call an electrician and was told the same thing. (that I would have to have electrical work done at my expense) The gas man asked me if the pool installers called 811 before they dug? I didn't know what he was talking about, and told him I didn't know. I was told at that time that they should have called 811 before they dig anywhere. I lost alot of food that was in my freezer that was in my garage, and honestly I was not too happy about that. Now on the 2nd day of July I discovered that there is a brick (that supports the sides of the pool) coming up through the bottom of my liner. I don't know what to do! I paid $1,464.30 for the pool and $650. to have it installed. I need these problems taken care of. I left a message on the phone at Rich pools to have someone contact me about the brick coming up through the bottom/side of my liner, and I am waiting for a call back from them. My friend called them to ask what they are going to do about the gas line and the electric and was told to have me call a plumber and an electrician. How fair is that? I rent this house and my landlord was kind enough to ok me to get a pool. I am a disabled widow who lives on a limited income and I am beside myself as what to do with this situation."
