Statement of Claim
Claimant says:
"Was on my e-mail & bed & bath offered free mdse, filled out a bunch of questions , there were a lot of other free items offered & ResVibrant offered free anti aging crème, just pay for shipping charges with your credit card which I did. Filled out over an hour of offers and decided I didn't want to go any further so I kept backing up & deliteing every thing but the one for the crème would not delete because of the credit card, so I closed it our. Some more appeared the next day & I deleted more. I did receive the free crème . There was nothing in the box except the crème & I was billed for the shipping charges and thought that was it but I happened to check my credit card account and saw a charge for $94.61. Icalled the number on the screen and it said a non working number. I then called AAA credit card & told them I had not ordered anything . They called & told the company I did not order & did not want anything & to cancel . They called me & gave me a new number & I called and told them I only agreed to the free crème & did not want any. I am 78 years old so my wrinkles are set in stone & not wrinkle crème would help. They were told this but sent the mdse anyway and now I am being charged 88.64 and they want me to make a special trip to the post office & pay 5.37 shipping charges at my expense when I did not authorize the shipment. AAA representative said they get ten calls a day on this kind of thing. Please tell me how I can get out of paying this. This has to be a scam making you think you are getting something free. Please tell me what to do.

    The goodwill and satisfaction of our customers is important to us. And, we look forward to a swift and satisfactory resolution in this matter. Please consider the following:

    1. When a customer places an order, we clearly verify the terms of our trial offer not once, but three times:
    a. First, we display our terms clearly on the order form stating “I understand and agree to the terms of this offer”, which is required for an order to be completed.
    b. We then send a confirmation email with order information and terms of our trial offer.
    c. Lastly, we enclose a packing slip with every order, which also contains the Terms of our trial offer.
    2. We also offer an unconditional 30-day money back guarantee. Customers must simply return the product with an RMA within 30 days for a full refund, regardless if the product was used or not! This means that a customer may use the entire bottle as long as they return it within the 30-day allotted time period.
    We feel confident that ResVibrant is one of the highest-quality and most effective anti-aging products available, so much so that we assume great risk to send a premium product on a trial basis for people to see results firsthand.

    Regarding your specific concern, we see in the customer notes that a call was made to customer service on 11/30/2015. According to the dispositions on the account, the customer called in and inquired about the reoccurring billing for ResVibrant. The customer was read the terms and conditions and was offered an RMA number to return the product. The customer made threats to the customer service agent and hung up before the issue could be resolved.

    We have processed refunds in the amount of $94.61 for October’s shipment and $88.64 for September’s shipment. Your account with Resvibrant has been closed and no future billings will take place.

    We apologize for any confusion that may have been caused as customer satisfaction is our top concern at ResVibrant.
