Statement of Claim
Claimant says:
"A couple of weeks ago, we contacted Carl Bishop with Remax (located at 9714 Potranco Rd. Ste 109 San Antonio, TX 78251; 210.680.9215-Office; 210.680.0634-Fax; 210.778.0789-Cell and clearly explained our needs as far as finding commercial property for a major halfway house project was concerned. As a result of the poor quality of services, our experience was a nightmare. There was no follow through, harsh, unprofessional treatment, poor follow-up, and we were left to believe he was not leveling with us in many cases. For specifics, please see the following:

• While we sent REMAX a list of 6 properties, they only lined us up with a viewing for one (La Vernia). The bad thing is I had traveled all the way from Dallas TX on 3/1/2012 for the purpose of seeing properties and only saw one.
• While were clear on the financing terms we were seeking and the priority (assumption, seller finance, mortgage loan, and all other flexible terms) Carl Bishop dismissed this and proceeded with the type of financing that would serve his purpose the best. Without contacting me beforehand, he had a loan offer to contact me before I was even ready to proceed, catching me off guard
• In the abscence of needed financial information to base a sound decsion on, we were repeated ly rushed to make an offer

• The one property we did see, a 24 unit apartment complex in La Vernia, we happened to like and expressed an interest. However, we had a number of common, routine questions regarding financials, etc which needed answers before making a decision and so emailed Carl Bishops To date, we have not gotten a response from Carl Bishop, have gotten excuses upon excuses, and thus feel stonewalled
• While we clearly stated the number of units we needed for our project (20+), Mr. Bishop continued to research 4- plexes and duplexes, and single room houses
• Whenever we followed up on status of information requested and the nonresponsiveness of the broker, all Mr. Carl Bishop could respond with is the fact that we were at the mercy of the broker. Clearly not something you tell a customer who is ready to buy
• Before leaving San Antonio on March 1st, we asked Mr. Bishop to research a list of 5 properties based on our criteria and schedule a viewing for March 9th, when we intended to be back in town. (I would be traveling from Houston TX and My partner from Dallas TX). He agreed, however, to date has only presented us with 1 and one that we could drive by. The other was clearly in another county which does not serve our needs.
• Today we tried to follow up again on the LaVernia property and still no answer. I had asked Mr. Bishop to schedule a call with the broker and he dismissed our request and did not comply.
• When I aired my concerns, he became belligerent, said if I wasn’t going to be understanding that we were at the mercy of the broker, then he would terminate our relationship. I also reminded him about how much we have spent (closed t0 $1,000) traveling to look at properties to no avail and in turned reminded me of money he spent on gas traveling to LaVernia.
• Most disconcerting along with this major setback is that we are booked (car and hotel for two people to go to SATX on 3/9/2012) with no visits schedule despite Mr. Bishop assuring us that he would schedule. These arrangements are nonrefundable.

Finally, when we mentioned that we intended to file a complaint with the BBB, Mr.
Bishop's only response was to threaten that if we did so, he would file a complaint against our company which clearly inappropriate and an act of retaliation given that we were seeking his services and had a rather bad experience and not the other way around and his complaint would have no merit or validity."

  • Mr. Bishop is anything but a hardworking professional and apparently there is a major credibility issue. The fact remains that he dropped the ball and when he couldn't snowball us anymore, he threw a fit, and threatened to terminate the relationship. Fact is, we expressed an interest in a property and he was supposed to get the financials. This dragged on unnecessarily, and he was not able to deliver, coming up instead with some excuse that we're at the broker's mercy. Since when is it that someone eager to buy commercial property is at the broker's mercy? Since when does a realtor say a potential buyer wants things to go too quickly? Isn't that every real estate agent's dream, a buyer that is ready to buy?? In any case, the second straw was his awareness that we were coming back into town to see more properties, b/c he agreed to line up those properties for us to see. At the 11th hour, he had failed to deliver yet again. All he had done was lined up a return trip to the property we had already seen and another property in Shertz. I assure you that the money he so called expended pales in comparison to what we expended. Luckily, we did attempt to make sure he was prepared for our visit; otherwise, we would have wasted more dollars.

  • 99% of everything Anthony Mungin states in this claim is false; just blatant lies. It is astonishing to me that an individual can slander the name of a business without having any verifiable facts. He was unrealistic in his expectations and now is angered by his own limitations; this whole claim is a result of that anger. If you are reading this; beware of this man; he is unethical and a very shrewd person. Antony J. Mungin with Managed Care Concepts LLC is attempting to extort a local small business and should be brought to justice.   • Because I am only stating the truth, Mr. Bishop's innuendo regarding my committing “slander” is false. In order for my statements to rise to the level of actual slander, those statements would have to be false, which they are NOT. Everything we said occurred, did occur. Conversely, Mr. Bishop’s own character assignations stated here are more likely to be construed as slander than anything I have truthfully stated. “Mr. Mungin is a shrewd business man...beware of this man...extort a local business”. How can Mr. Bishop make these accusations having only known me for less than a few hours and after only a few telephone conversations? Is this a rush to judgment on his part? Is this his own display of anger over a potential buyer refusing to be taken advantage of? How rash is it to accuse someone of “extortion” without fully understanding all of the required elements of an extortion claim? Further, I did not get the impression that his newly opened real estate franchise was raking in that much money that would tempt ANYONE, let alone another business man to want to commit extortion. It goes without saying that there can be nothing further from the truth. Fact is, even Mr. Bishop himself agreed and was apologetic that the financial information he agree to obtain was taking too long. I believe the agent on record did also and so in this instance we, the potential buyer, were stuck in the middle of a situation where no one wanted to take ownership and get resolution. As for the matter of coordinating the viewing of additional properties that were supposed to be lined up, we can provide names of practically every real estate agent we contacted that day asking for a miracle (i.e. to find us properties on short notice) due to our sense of urgency which resulted from the fact that Mr. Bishop left us hanging and did not seem to care that we had made travel arrangements based on his prior commitment to us and those arrangements were NONREFUNDABLE. If being shrewd is shining the spotlight on a so called businessman who lies, misleads, misrepresents, fails to show diplomacy, does what is in his own self interest rather than the potential buyers he represents, then I guess we’ll just have to wear that badge. I assure you that anyone who really knows me/my business for being the diplomats that we are would vehemently disagree with Mr. Bishop’s false accusations and misrepresentation. The claimant's settlement terms were rejected with the following explanation:

    "100% absolutely bogus claim.

    Anthony J. Mungin with "Managed Care Concepts, L.L.C"contacted my organization through our website. He claimed he was in the market for a commercial building and wanted to move forward with the transaction as quickly as possible. He stated that he wanted a property outside San Antonio city limits however inside Bexar county; multi-family units to use for a "half way house" we sent him several preliminary properties to consider. He wanted to do things very quickly however was very secretive about his finances or funding capabilities; however in good faith I did agree to take the claimant out to look at one of the properties he had selected online. Once I got a better understanding of the criteria required I informed him that is would be much more difficult to find a property that would match his criteria. However he continued to press how quickly everything had to be done; he requested several items of information on the property we viewed which I in turn pursued the listing broker for; the listing broker agreed to get me the information however did not produce it despite multiple requests. This was not good enough for Anthony Mungin; he became very offensive and contentious; he was angered that the information was not produced despite the fact that I had no control over it's release. I informed Mr. Mungin that I would not work with an individual or company that treats hardworking professionals with dis-respect and malice for not providing information that may not have ever existed int he first place. He then proceeded to make threats that he would contact the BBB.
