Statement of Claim
Claimant says:
"They have applied for balance transfers on credit cards to other banks without my consent. Now I have 2 credit card companies that have transfered the exact same accounts. I have been in contact with them all. This problem started with a phone call to me, they were pushy, I expressed that I didn't feel comfortable making decisions without discussing with spouse and that I didn't want to pursue changing credit cards to lower interest. I was told that it was " to late". I was quite stunned by this remark and didn't really know what to do. They sent me a form to sign for permission to contiunue progress. I didn't sign the form. I faxed it back to the company the next business day. I had drawn a line across the signature portion and wrote CANCEL. On the fax face sheet I wrote that I did not want to procede with this and to stop all of the proceedings. I received a fax conformation that it arrived at their fax. I thought things were ok. I did not hear back from them. I received a registered letter to sign per mail, I refused letter and sent it back. I received HSCB credit cards in the mail that said to activate. I did not. I mailed the cards back to the company and sent a note attached that told them that I did not ask or authorize this credit card account and I wanted it closed. Then 3 1/2 weeks later I get this statement from HSCB about 2 accounts that were transfered to them. I immediately contacted Premiere Debt Solitions to inquire about what was going on. I told them that I did not give them permission to do what they did. I asked it they had received the fax I sent and "Ann" said she had it in front of her. She then transfered me to her supervisor. I told him the situation and he said that he would refund the $1095.00 fee they had attached to the balance transfers. I expressed my displeasure on what was going on. I expected every thing to be transfered back as it originally was. Several days later I receive another credit card to activate by mail, Coast to Coast Visa. I called the company this time and told them that I didn't request this card and that I was not going to activate the cards and to close the account. Yesterday I received a letter confirming that they closed the account but there was a $8,817.21 balance on this. I immediately called the company. Again it was the same balance transfers that HSCB did plus one more. I explained the situation. I have to call their investigators today. I have been in contact with all of the credit card companies involved. 2 chase, 1 sears, HSCB and Coast to Coast. I need your assistance please."

  • 08-16-2010 — I received a call from Premiere Debt Solutions. Their purpose was to inquire about my credit card status and interest rates. They are very pushy, I was uncomfortable about talking to them and giving out information. I was so hesitant that they changed the person who initiated the call to a woman named "Ann". In the process they spoke of a fee for mediating with credit card companies. $1095.00 that would be pulled off the top of balance transfers. When you are on the phone they cut contact and are speaking with other companies. They have a recording that says all calls are recorded. If this is so, you will find that I was hestitant, and made the remark that I did not feel comfortable procedding without consulting with my husband. And later I said that I didn't think I wanted to do this. And was told by Ann that it was to late. I was like stunned and didn't know what to do. She said she had made arrangements with HSCB bank and that I would have 0% interest x 6 months. and to call her if I had any questions. They were going to send a registered letter for me to sign and would also email a contract to sign per email. I didn't know what to do, I felt trapped. Phone number for Ann is 866-387-4705 ext. 1015
  • 08-18-2010 — That evening I received a contract form to sign to agree to the conversation on 8-16-10. I copied the form.
  • 08-19-2010 — I faxed contract form back to premiere debt solutions with CANCEL and an x across the portion that required my signature. I received a confirmation page that it went to said destination. Time was 1318 CT
  • 08-21-2010 — Mailman delivered registered letter for me to sign but I refused it and sent it back. I also received credit cards for HSCB some time close to this date. I did not activate cards and I sent the cards back to them with an attached note that I did not request or authorize this. And to please close this account. I failed to write down the # on the cards and the contact phone # but did know that it was from HSCB in California.
  • 09-11-2010 — I received a letter in the mail from HSBC in forming me that "they had transfered balances as directed in the amount of $5,596.12" to my GM account. I was to call the customer service # on the back of my card if I had questions. This came as quite a shock to me. As I thought is was all taken care of. I couldn't call them because I had no card or phone number. I couldn't call Premiere Debt solutions because their hours are 9:30am to 5:30pm ET Monday thru Fridays.
  • 09-13-2010 — I called PDS x 2, left message for Ann to call me. Did not receive any call back.
  • 09-14-2010 — I received a call back from Ann, discusssed my displeasure with what was going on, discussed that I did not want to proceed with balance transfers, told her that they should have received a paper inwhich I did NOT sign or give permission for this to occur. She denied telling me that it was to late but I imformed her that she indeed said that to me because I remembered being "Stunned" by the remark. I also inquired it she had the paper I had faxed and she said that it was in front of her. She then transfered me to her supervisor "Sean Rogers" (866-387-4705 ext. 1507) I told him the same things. He said that he would refund the fee of $1095.00. I was under the understanding that they would call the banks they contacted to correct all of these problems ( I later found out that I was mistaken). I took his # above to call if further problems came up. He could not provide me with bank information regarding who the transfers were set up with.
  • 09-16-2010 — I found a # for HSCB, was unable to retrieve full acct. number to credit card issued in my name. I spoke to "Anthony" 888-385-8916. Discussed what was going on and he refered me to "Maria" started fraud claim. All information I had I gave her. I found out that that account in my name did get closed August 31,10. There were 2 bank transfers that went out on September 2nd, 2 days after the account was closed. One to Sears in the amount of $2,652.58 and Chase $2943.54. My information was sent to the investigators, and they were to contact me on my cell #. Invest. # 800-395-8141.
  • 09-16-2010 — I called Sean Rogers, left a message to call me back. I had checked my Chase accounts on line( I have 2) and found that another bank transfer had a taken place on 9-14-10. I was extremely upset with all of this. Sean did call me back 4 hours later, wanted to know what I needed and said that he refunded the money. I inquired about further balance transfers and did not get much of a response. I mostly wanted to know why I did not want their services.
  • 09-16-2010 — I received credit cards in the mail from Coast to Coast Visa to activate. This time I kept the cards and called the #877-408-8866. I informed them that I did not request or authorize for this card and that I wanted the account closed. I spoke with "POA" and he was going to send a confirmation letter.
  • 09-23-2010 — I received a letter in the mail confirming the closing of acct. under Coast to Coast but there was a balance due of $8,817.21 that needed paid. I immediately called that card company and informed them of the happenings. I spoke with "Brenda" and she recorded the information on the record with the account. I was to contact them on 9-24 and speak to the Security department. 888-232-0776. They transfered 3 card balances-$2996.09, $2943.54, $ 26852.58.
  • 09-13-2010 — I contacted all of the credit cards that had been paid-Sears, Chase and informed them of all that was going on and they were to freeze everything and wait. I have a credit balance on all, because I was making payments at the same time all of this was going on.
  • 09-24-2010 — I have the letters from the credit companies and contract paper that I faxed to the PBS with confirmation page. I am unable to send with this. I can fax them to you if you provide me with a # .
What Claimant Wants Hide
Message from Claimant: I did not contact them, they called me. When they contact people they lead you to respond to all of their inquiries. They pull off their fee right off the top. In the response that I said to go ahead with the GM account is not accurate, I told Anne that I didn't want to proceed and she said it was to late. I am still in the process of getting all of the banks straightened out. They had 2 banks do balance transfers for the same accounts. The main thing is that I did not sign their contract, I sent it immediately back to them with cancel all procedings written across it. They were well aware. Yes they did refund their fee which I am grateful, but this is a mess. Jeanette Gunkel
