Statement of Claim
Claimant says:
"Long story short i took my car to them a total of 3 times to fix 1 problem completly which was a tune up. They didnt have engine coils needed to complete the job so i went out and bought my own coils and asked them to install. 2nd time i went to them they installed the 1 coil as i had asked no problem but car ran choppy again 3 weeks later i asked them to install a similar but more expensive part. they charged me but after no change in performance i took 6 new coils to a second shop (Duxler Auto) and i asked for my parts to be returned. none of removed parts were the part i hired meineke to replace the 2nd time."

  • They would have gotten away with not replacing the part if it weren't for the fact that the part i asked them to replace was found un my engine afterwards by other repair shop. The part i asked you to rerurn to me never reached my hands. Instead i was given a similar (decoy) that was never purched by me nor was ever in my engine. Refund me asap im not giving this up

The claimant's settlement terms were rejected with the following explanation:
  • I disagree with the explanation / grounds provided

    "The customer brought the Duralast coil from Auto Zone. He then brought another BWD brand coil. Mieneke charged a labor fee to install them. The manager told the customer that the part was not a OEM part. It was recommended that he get a new coil from the Chrysler dealer. This was declined by the customer. The store advised that installing this coil would not resolve the issue he was trying to resolve and that, since it is customer supplied, there is no warranty on the part and labor. The customer told Meineke to proceed with the supplied coil without warranty. The customer was waiting in the office while the work was being done. The mechanic replaced the coil and provided the used coil to the customer and showed the customer the work that was done. Due to the fact that the Meineke location communicated all of these up front with the customer, no compensation is being offered."

  • I read both the claim and Meineke's response and the response doesn't seem to address the issue. 

    If I understand this correctly, the claimant is saying that Meineke did not install the parts provided but used some, or at least one, different parts. 

    When the claimant took his car to another mechanic for all new coils, the mechanic returned the coils (per his statement on the attached bill) and none were the parts purchased by the claimant and given to Meineke.

    It's fair enough to say that Meineke did not guarantee that the work they did would fix the stated problem, but that dodges the issue of whether the parts provided by the customer were actually installed.
