Statement of Claim
Claimant says:
"For a month now I've been talking to them on returning the product because , I have health issue . Worried that I won't be able to pay . Talked to the manager Adrean and Allan couple of times helpful but , according to them I can't return because that is their procedure . I told him that I didn't even use it . 10 days after the purchased my health issue came about . I've been shopping for years , this is the first time I've encounter this silly excuse from a company . I told them when I am sure that my health issue is ok, I will still consider to buy their product . I'm due to pay for my payment Aug 24th . Supposed to be I won't complain but they just kept on promising that they will call me . Now , I'm the one that will be at fault behind on my first payment . Please help me . 😒"

    To Whom It May Concern:

    Thank you for allowing The Kirby Company (the “Company”) the opportunity to address Ms. Rassel Di Ramos’s (“Ms. Di Ramos’s”) concerns regarding the Kirby cleaning system she purchased on July 10, 2014 from EGA Marketing, an authorized, independent distributor of Kirby products located in San Jose California. Please note that while this complaint was registered against Bama Marketing, said entity is not involved in this matter.

    As a matter of information, the Company manufactures high quality cleaning systems, which it sells to independently owned and operated businesses or “distributorships,” such as EGA Marketing. These distributorships, through a network of salespeople or “dealers,” then sell the cleaning systems to consumer end-users via in-home demonstrations. As such, the Company’s relationship with the distributorships is that of vendor/vendee.

    Since the Company is not involved in the retail sales of its home cleaning systems, we are unable to cancel purchases or rescind contracts between distributors and their customers. However, we take all complaints against our independent distributors seriously, and when Ms. Di Ramos contacted our Consumer Relations Department in September 2014, we immediately started an investigation into her concerns.

    When Ms. Di Ramos contacted the Company, she advised that she was unable to make payments on her Kirby system to the finance company due to unforeseeable bills she acquired after her purchase. The Company forwarded Ms. Di Ramos’s concerns to EGA Marketing, and the distributorship responded by advising the Company that Ms. Di Ramos’s cancelation request was outside of the three business day cancelation period known as the federal “cooling off” rule. Furthermore, any other remedies that may have been available to Ms. Di Ramos were inapplicable as her alleged medical condition came about after her purchase. As a gesture of goodwill, EGA Marketing contacted the company with which Ms. Di Ramos’s Kirby system was financed and lowered her payments to accommodate her financial situation. Ms. Di Ramos agreed to make the lower payments.
