Statement of Claim
Claimant says:
"I was solicited for a chimney inspection. When the contractor arrived, he told me I needed a new box and liner for the chimney which would cost $4,200. I told him I couldn't afford that and after talking for a while, he said he would do me a favor and do it for $2,000. I gave him $1,300 in cash for him to buy the materials and he was going to install the next day. However, the next day he told me the box was custom and wouldn't be ready until later and he would install the next day. When I called, he told me he thought we said on Monday and he hadn't even picked up the materials. On Monday morning, I began calling him for 2 hours and his office finally called me back an hour after that and said they would send someone out. Later John told me he had been feeling sick, but he would come later that afternoon. I was feeling so uneasy about the agreement, that I decided to cancel the contract and I told him so when he arrived. He told me that I would have to take the custom-made chimney box which cost $750 and he was going back to his office to write me a check for the difference and give me the receipt for the materials. He did not return and would not take my calls or call me back when I left a message."

  • I had another chimney company over to see if I needed a new chimney and liner, and they told me that my chimney was old, but functioning correctly and no work needed to be done at this time. The chimney that John brought over to me was not really appropriate for my house and at this point, I don't need it at all. John is still not taking or returning my calls and shows no signs of doing the right thing by refunding my money.

  • I have been trying for the past two weeks to get a refund of my $1,300 cash. Last Friday, John offered to give me $950 and leave me with a chimney that I cannot return for $350. I tried to find the phone number of the chimney company that made the chimney, but when I couldn't find it, I then asked him to return the chimney and give me my $1,300 back. At this point, he refuses to do anything and has left me with a chimney that I cannot use while he has my money. He doesn't seem to feel that he owed me anything.
