Statement of Claim
Claimant says:
"My husband and I signed a 12 month lease agreement with Mr. Falcone which states at the end of our term we would have first option to buy or we would be on a month to month and he would be able to show the home for the purpose to sell. At the beginning of August, 7 months into our lease, he began to ask if we had begun the process of buying and asking us who and what bank we were working with. When I told him we were possibly going with Chase because that is our bank, he went to the bank loan officer and asked him about our financial situation. Since then he has been calling and asking every week. He has stated to us that we were on a month to month basis and we had to let him show the house to potential buyers. I have tried to ask him how are we on a month to month if we have a contract. He states that I am reading the contract wrong. The contract states we are no to have dogs on the premisis and we did dog sit for my father for one week in July and Mr. Falcone saw the dog and said that was fine. Now, specifally today, he tells me we are in default of lease. When I told him there was no dog here he stated that we painted the home and that was default, but the lease says lessee shall paint and decorate the interior of the home at their own expense. I have called Mr. Falcone to ask him if he wants us out to terminate our lease and we will be out in 30 days, but he has not returned my phone call nor answer when I call. As to our knowledge, this is not the first time Mr. Falcone does something like this to a tenant. We are now aware that he is in court with two other tenants prior to us. We have done nothing wrong here and now we are being bullied and pushed around by our landlord and in a situation to try and move our 6 kids. Mr. Falcone has not honored our lease and we would like to stay but without the problems. He stated we can stay but we have to allow him to show the house to buyers. That I feel is an invasion of my family's privacy. We are up to date with our rent and when we were late 2 months out of the 7 and when were knew we were going to be late, we notified Mr. Falcone and again he stated as long as we added the late fee there was no problem. What can we do in this situation?"
