Statement of Claim
Claimant says:
"Mr. Spence was hired by me from Craigslist to repair and repaint the bumper covers on my 2006 Ford Taurus. Mr. Spence said he could repaint them for $50.00. Mr. Spence picked up my car and said it would be ready in 2 days. Because of weather, it was raining and cold, Mr. Spence requested $140 in advance so he could rent a paint booth to do the work. The money was given to Mr. Spence. 2 days later Mr. Spence called and said my car "had been hit" and needed some repair to the frame. I questioned this as I saw the carfax of the vehicle which reported no accidents, Spence stated, "they didn't report it". He also asked how fast I could get him the $200 so he could start the repair. After many texts and calls that were vague as to what work actually had been done, I asked Spence where the paint booth was so I could check on the work. Spence told me 91st ave and Glendale ave. There is no shops on that intersection. He then changed his story to say the shop was on Glen Harbor drive, about 2 miles west of the first location. When pressed for the address, he could not give it and offered that it was the 5th building on the left. When I asked him to meet me at a close by gas station to show me the place he said he was buying paint for the vehicle and would be an hour or so. After waiting an hour I called again and he tells me very conveniently that he just had an accident and couldn't make it. He further stated that his "helper" had trailered the car to Mr. Spence's residence and told me I could look at it there. He pleaded with me not to lift the tarp on the front of the car as it would disturb all the work he had done so far. I just went home at that point but things didn't feel right so I went the next day. My car was in the driveway of Mr Spences house at 6929 Mclellan Drive, Glendale Arizona. No one answered the door or either phone number he provided. I lifted the tarp and discovered that absolutely no work of any kind had been done, he had told me earlier that the front bumper was done and he had blended the paint into the body of the car making it look new. The original cover was still in place and untouched, no blending or painting of any kind had been done. At this point, after many lies and 6 days, I had enough and just drove my car home with my spare key. Since that time which was 2:30PM 11/25/13, I have sent 3 text messages explaining my displeasure and requesting my key and refund of my money. I also tried to place calls to both numbers he used in calling me. Since he did not call me back or answer in any way I had to call a locksmith and have my car reprogrammed at a cost of $160 so he could not use my key that was in his posession for any further misdeeds. Again, I have copies of all the texts he had sent telling me about work he said he completed but did not. An independent ASE certified mechanic told me that no structural damage was present in my vehicle as Mr. Spence claimed he repaired."
