Statement of Claim
Claimant says:
"April 6, 2015, I went to my appointment with Dr Perez. During the appointment as he was examining me, he held my thigh with one hand and my calf with the other. He forcibly twisted my lower leg to the right. I yelled and my reflexes pushed his shoulder. He said you have some arthritis in you knee. I told him my knee hurt from that and he prescribed Vicodin (180 tablets in total) and an anti-inflammatory pill. My husband was in waiting room and heard me yell. By evening I could not put any weight on knee, walk and wobbled back and forth when I stood. I gave it some time for the medicine but was not getting any better. I contacted the office and told them I couldn't stand or walk. I asked for an orthopedic appt. as I knew it had to be an injury not just arthritis. Dr Perez got me an appt in his network with an orthopedic surgeon. He took an x-ray and said a little arthritis. He gave me an other inflammatory and pain killer. The paid never subsided, I couldn't stand or walk. I was afraid of all the hydrocodone and the pain became excruciating. Going into the bathroom was a challenge. I ended up at CMC emergency room for help and they sent me home with a walker. I asked for a second opinion and another one of his network surgeons did not take any x-rays and said all I need was an bariatric surgeon. I left on that note and called my health insurance company and argued to go out of network because they all said they would not talked against another doctor. Finally after appealing, I got an appt with Dr Moran, an orthopedic surgeon in Concord, NH. He immediately ordered a MRI at the hospital. I had what he called (an enormous torn meniscus and arthritis. I had surgery in July, I walk some with a large brace and a walker Dr Moran said it was going to be a long slow process if I walked alone again. I am now 10 months into this."
