Claimant says:
"I had a 2005 XLR Caddilac & I pulled in to look at what they had. I am a 69 yr old female & have back & neck surggeries . They drove my car & came back & all the water was coming out of radiator, I ask them to put water back in & let me go. My car only had 59,000 miles on it. They ask if there was anything on the lot I wanted. Told them the only thing I seen was the color of a red truck but it was a 2012Ford XLT & too big for me, I'm only 5'1. They would disappear everytime I ask about my car. I got there at 11:30 am at 8 pm had papers on the truck & I was in so much pain I would have drove a Volkswagon to get home. I was over $10,000 in debt for truck & I haven't drove it since I got home. I knew i I fell I would have problems. well everyone told me what a fool they took me for. I looked online & they had ad for car extremly clean & only 59,000 mile & had it for sale for $21,999, same price of 2012 truck they pushed me in and I was in debt for over $10,000. I'm on SS & had to set up payments. I have access to a 2000 Nissan I sold my friend and I have drove it since. Being my age hate people taking addvantage of and they DO!"

The claimant's settlement terms were rejected with the following explanation:

  • "Ms. Young is now having buyers remorse. Like most people she is over valuing her trade in. The unit was no longer running. Even if we filled the radiator with additional water it would not hold it. The radiator was shot. The unit had to be towed from our location in the hopes of having it repaired. The unit she mentions that she saw on line was not her original vehicle and did not need ANY work on it for us to be able to resale the unit. When she left our dealership she was happy with the unit. No one here made her sign the paperwork."
