Claimant says:
"I have been a patient of Goldstein and Freud for about three years. My last visit there, sometime in November, I had a post and crown ( done previously that kept falling out ) glued back and a filling on a single tooth, lower right side. When I went home I started having mild discomfort in that area and within the next couple of days the tooth next to it started coming loose and I was in distress with tooth ache and pain. I made an appointment soon after to find out what was wrong. Dr. Friedman attended me and upon completion of a series of X-rays told me that the area in question, lower right, was infected. He gave me antibiotics for treating the infection. I subsequently went back to have the post and crown glued back as it had again dislodged and discussed appropriate treatment for the infected teeth. As I recall they wanted to charge me for further treatment, including extraction of the teeth they caused to be infected, probably from using contaminated instruments. I am disillusioned and feel victimized by the lack of concern and professional responsibility for a problem they incurred through their own negligence and which I am at a loss to understand."

  • Because of the deterioration of the two teeth in question, as a result of the infection which affected their condition, both have to be extracted. My Oncologist , Dr. Craig Zalvan of Phelps Memorial, who has been treating me concerning my recurrent oral cancer problem in that area, has recommended the two teeth be extracted. The charge for extraction by my present dentist is going to be $1,183.00. That is how I arrived at the claim amount. Upon settlement I will fully oblige re: Dr. Goldstein's request.

  • We had availed ourselves to you in order to address your dental issues and needs, as you had presented to our practice for treatment.

    You had appeared to become frustrated in what you had perceived as “a long wait” in our waiting area.

    You further stated that you had become “discouraged”.

    You demanded to have certain documentation that you had provided to us returned to you, which had become part of your patient record; we could not allow you to take it and you were told so.

    We regret that you have become dissatisfied with some of the treatment rendered to you by us.

    You had already resigned yourself to removal of certain teeth at a discounted contracted fee.

    You have chosen to seek treatment elsewhere with a practitioner who is charging exponentially higher fees for the same treatment.

    We have made you a counter offer of $500 which we feel would be more than fair and reasonable in settling this matter, considering all the factors involved in your case.

    As such, we will not consider reimbursing you for treatment you have seeked elsewhere. Our final settlement offer to you is $500.
