Statement of Claim
Claimant says:
"On july 29,2016
the below mentioned company came to my home in Orlando Fl and removed my belongings without proper authority to do so i was out of state at the time and only wanted certain items packed and moved to a storage unit near my home. Gm proceed to bill my credit card for the sum of $2100 plus additional charges of $$750.00 to date they have not sent me an detailed copy of my belongings or where they are located I just received an em stating they will be selling my belongings my credit card company has deemed this action fraud on the part of GM Van Lines I also hired an attorney to assist with this situation and to date no resolution has been forthcoming the attorney charged me $2000.00 non refundable and now wants an additional $4000 to take them to court .

  • On 7/31/16 GM Van Lines did go to my home on that date however I was unable to return to Orlando at that time and called there office to inform them of this situation. However at the time of my call I was told they were already there. The young man they had sign there work order was never authorized by me to sign any agreement he is my tenant and at that I had a management company working with me and did not know the tenant at all at about 12:30 pm on said date I contacted my neighbor to go over to my home he was the only person allowed to make any decisions on my behalf no one else. The first time I spoke to any one from there company was when my neighbor went over and approached the men working at which time they tried to get him to sign and he refused and advised GM Van Lines to contact me the person got on the phone and I asked can the paper wk be em or faxed to me he responded he would do so. They also had me believing they were a local company in orlando Fl. That alone was deception on there part I would not have placed my belongings 2 -3 hours away from my home. I hired an attorney for help with getting my belongings back at which time GM Van Lines offered to settle for $2100.00 but I have to pick my belongings up from there storage location t 2033 W. McNabb Rd, Pompano Beach Fl 33069 or I would be charged for returning my belongings. They are also requesting that I remove any post online. I've contacted my attorney regarding this and I'm awaiting a response this is the only place I can have my side heard and will not give up my right to free speech and justice. Who knows how many others have been treated like this by GM Van Lines!!!!

Respondent's Counteroffer Hide
The claimant's settlement terms were rejected with the following explanation:
  • "Mrs. Gladys Daly contacted our office on 07/28/16 requesting last minute relocation services from FL-FL. Customer was provided an estimate for $898.00 for transportation services since customer had informed our office that she would be responsible for the packing; following act the customer informed our representative that she agrees with the estimate and would like to move forward with the move, Mrs. Daly provided a deposit with her credit card to secure her move date, on which she requested for 07/28/16 at 6:00pm EST.

    After Mrs. Daly’s move was scheduled, our office received another phone call 3 hours before the scheduled pickup time where the customer informed that she had to postpone the move for 07/29/16 with loading between 1-3pm due to missing her flight; our office kindly assisted the customer and accommodated her new date request at no additional charge.

    The morning of 07/29/16 the customer called our office again requesting to reschedule her move for a 3rd time, indicating that her flight was cancelled. Once again our team rescheduled Mrs. Daly’s move and accommodated her new request to move on 07/31/16 at 8:00am.

    The movers arrived on 07/31/16 at 08:00AM as per confirmed and agreed with customer for loading but the customer wasn’t at the location nor informed our office she wouldn’t be there. Our foreman immediately notified our office about the situation and our main office reached out to Mrs. Daly where the customer notified our representative that her flight was cancelled again.

    We understand situations happen, but this situation was becoming very unusual and strange but our company decided to continue assisting the customer and the customer agreed with our Office Manager that a representative of hers; Mr. Brandon Shaney would show the movers what needed to be loaded and moved.

    When the movers proceeded to verify the items that Mr. Shaney was showing to our crew, they realized Mrs. Daly didn’t do any packing at all and the goods were not ready for loading per agreed. Mrs. Daly was called immediately and was informed of the situation and explained that since the goods were not packed the move would take more hours and she was provided a revised estimate including the packing. Mrs. Daly agreed to the revised estimate of $2,188.00 and notified our Office Manager that she needed the movers to take everything out of the house. Mrs. Daly’s representative; Mr. Shaney signed the revised estimate in order for the crew to start the job.

    The next day Mrs. Daly called our office complaining that our crew loaded items that they were not supposed to load, to which our representative explained to the customer that the items that were loading were exclusively the items told by her representative to move.

    As you can see our company went above and beyond in order to assist Mrs. Daly, rescheduling her move without us being provided fair notice which caused for us to have to decline service to other customers because we tried to accommodate Mrs. Daly needs. Our crew did not start the loading until Mrs. Daly agreed to the revised estimate and the estimate was signed by her representative.

    Mrs. Daly was not overcharged and our company and crew proceeded as per instructed by the customer and what was agreed in a Binding Contract with the customer. Copies of signed paperwork are available for review upon request.

    In addition to our numerous efforts to assist Mrs. Daly, we went further and offered Mrs. Daly 3 months of free storage valued in $900.00 and the delivery out of storage for $432.00 in order to resolve the dispute with the customer. However after all of our good faith gestures and efforts to give the customer the service of excellence we provide to our customers she still insisted in getting more out of our good faith and take advantage of a situation.

    Our goal is to satisfy our customer but unfortunately and the reality is that not everyone will be pleased regardless of the efforts one makes. As mentioned previously and proven we tried everything we could

    This said we respectfully request to be dismissed from this complaint as our company did everything in our hands to assist the customer and the services were rendered as per agreed between the customer and GM Van Lines.
