Statement of Claim
Claimant says:
"I went to look a vehicle and put a $700 deposit down to hold the vehicle for my wife to come in on the weekend to look at the car. I asked if I was not interested in the vehicle could I get my deposit back and I was told yes. My wife came in and found rust on the car and did not want the car. I called and told them that I did not want the vehicle and asked that they refund my deposit. I was told that I would have to talk to the owner. I placed over 20 calls and never got my deposit back. I contacted my credit union to file a complaint and was given a credit to my debit card by the credit union until further investigation. The credit union debited my account and said that Francisco Automotive refused to pay back my deposit because I signed a purchase agreement. I never agreed to purchase this car I was only told to fill out the paperwork to hold with the deposit. I have gone by the dealership several times and placed numerous phone calls. The credit union has a relationship with the car dealership and they have placed several phone calls to the owner and he is refusing their calls as well. I only wanted to hold the vehicle but did not want to purchase once I saw the rust on the car. This has been going on for about a month and I am not sure how I can bet my money back. I am not sure why they are refusing to refund me my deposit. I called on 12/28 and was just informed that the business is closed"

  • Because you have stated in your claim that the business has since closed, perhaps filing a complaint with the Attorney General’s office can be of some assistance to you. A consumer protection complaint and investigation can potentially see what potentially remedies you have available to you, especially since the business has closed without resolving your issue and complaint.
