Statement of Claim
"Fl energy Service came to my home to seal my doors. (Air leakage- home 5 yrs. old- built by Thompson's for me.) At that time of their visit we found mold leaking around the vents on the ceilings inside my home. They responded by re-taping all the leaking duct tape, re-insulating the attic and boxing in all ceiling lights etc, for a total cost of $14,272.68 Cause: poor workmanship by the builder and his contractors. My HOA refused coverage; builders Ins. does not cover poor workmanship; builder out of business. Upon inspection 6 months later, more mold found around the air handler unit. Fl Air and Energy says they are not responsible. Comparative estimates relate that the original job could have been done for approximately $5000.00. Fl Air and Energy have refused to even schedule a visit to look at the existing problem. Invoice itemized "Inspect Air Handler"."

  • I only ask that you visit to observe the problem however your scheduler flatly refused and claimed that you were not responsible. I would think that someone other than your scheduler should make that decision!

  • IO would like to have Terry Statton to deny the fact that Fl Air and Energy was NOT hired to take case of the mold problem in the attic. He was here when the insurer came out and talked with him. My motivation to hire Fl Air and Energy was entirely due to the mold Terry and I found on his initial visit. He ensured me that the problem would be taken care of and yet, this week I found mold in the box covering the air handler!

The claimant's settlement terms were rejected with the following explanation:
  • I need more information

    "We need copies of the comparable quotes along with contractor names, license numbers, proof of insurance, product specifications and contractor resume regarding their experience in this industry."

  • I disagree with the explanation / grounds provided

    "We contracted with Ms. Walsh to make improvements to her home. We completed the work, she signed our completion form rating our company as "very good", and we were paid. As Ms. Walsh states, we only contracted with her to "inspect the air handler", which we did. We did not contract with Ms Walsh to do any mold remediation whatsoever. As Ms. Walsh states, her house suffers from "poor workmanship by the original builder and his contractors." We did significantly more work than "re-taping all the leaking duct tape, re-insulating the attic and box ing in all ceiling lights etc" as per the contract. When we finished the project for Ms. Walsh, she indicated that she did not have funding to make any more improvements to her home."
