Statement of Claim
Claimant says:
"This company took my money, but I didn't receive any resolution to my financial situation. The person in charge (Todd Myers) ignored my requests for a refund after many of my phone calls were not returned. He would personally promise "out of service". He had promised me that the accounting department was refunding my money. I never heard from any of them again. This company owes me $331.25. Fortunately, I was able to stop the automatic payments through my bank. This is what they still owe me in refund."

  • In September of 2012 I entrusted First USA Data Services to fulfill the agreement we had to lower my interest rates drastically or eliminate them completely and/or secure a signature loan to consolidate my credit card debt. Yes, it's true we made a list of my financial obligations (we did not make a budget that I was in any way able to live by) and we also sent letters to all three credit bureaus. I had to print up the letters, put them in envelopes and put postage on them myself. I then mailed them, and nothing was changed or improved by mailing these letters (my credit score remained the same). I was promised at the very beginning that First USA Data Services could improve my financial situation by having the credit card companies reduce my interest rates drastically or eliminate them altogether. Only later on, when it was apparent this could not be accomplished by First USA Data Services, the idea of securing a signature loan to consolidate all of my debt at a very low interest rate was introduced. Had your company been able to do either one of these things, I would have been in a greatly improved financial position, and would have been very satisfied with those results. When it became apparent that First USA Data Services could not fulfill this promise, I felt this was the point that I was "put on the back burner" so to speak. It is at this point in our relationship that my numerous voice mails would never be returned. If I did finally get to speak to Mr. Myers, a promise would be made by him that he, or someone else would call me back to make a phone appointment. (If) they called back and made the appointment, when it came time for the appointment, I would almost NEVER get a call. So then I would have to call Mr. Myers back, and the same exact scenario would transpire all over again. This went on for several months!! I was much more patient that I should have been under the circumstances. I put a "stop payment" on their automatic deductions from my bank. Then they knew I was serious. I did get a credit of $66.25 at one point. But since First USA Data Services had NOT fulfilled their promises to me, I wanted the remainder of my money they owed me, in addition to my mailing costs as it made no improvement in my credit scores at all. Finally, Mr. Myers had agreed to give me a refund. He set me up with Lynette and she told me she had sent the full amount of $331.25 to the accounting department of the company, and they would be mailing a check. I never heard from any of them again. I made numerous calls and left many messages, with NO RESPONSE!! This has dragged on and on for too long. It was clear that First USA Data Services was not going to work with me. Then after a period of time, I called the numbers again, and one had been "disconnected" and the other said it was "no longer in service". I had no other recourse than to try to get my money through "PeopleClaim". I don't agree that a one month refund of $66.25 is fair. First USA Data Services was completely confident that they could improve my situation. They clearly could not keep up their promises to me. Therefore, I want the full $331.25 Mr. Myers promised me. I'm willing to let the supplies, postage and cost of using "PeopleClaim" go. But I want and feel I'm entitled to the FULL REFUND I WAS PROMISED!!

The claimant's settlement terms were rejected with the following explanation:

    "Julie Buehner was a customer of ours starting on September 6 2012. We worked on her case to help repair specific credit issues and obtain funding to pay off other debt of hers. We can not discuss the situation but we were unable to help her, she continued the same actions that caused the issues in the first place. Mrs. Buehner was on a 12 month payment plan of $66.25 for our services. She paid several payments and failed to continue to pay then cancelled the service. We refunded one months of service for her. We have budgets, letters to her creditors, applications for support. She canceled, we refunded a partial amount. She has never mailed us any documentation. We have only received faxes and emails. Her claim she has $50 plus in mail services is not accurate. PeopleClaim will only remove this complaint if I pay off the claimant and PeopleClaim. She signed a written contract, paid partially, canceled and received a partial refund. We feel we earned a partial fee for services. For whatever reason she could not stop or alter her course of action to correct her specific issues. We will agree to give her an additional month refund to settle this claim. "
