Statement of Claim
Claimant says:
"10/6/15-Rcvd call from James-Underwriting-800-615-6261 that Evergreen Legal Service could help us with our mortgage to get a lower interest rate . I Sharon Miller than spoke to David Anderson(Authorized Case Manager) that went over how/and if we qualified for the Govt loan. By signing these papers lets Evergreen"Represent" us with our mortgage company to be able to get the govt loan. The process of how this would work was explained to us and was told that our payment to Evergreen would be total $2940.00. And, if we were not satisfied with Evergreen we would be refunded out money .The first payment was for $1470 to start the process and by 30 days another $1470 needs to be paid. The documents for Evergreen was emailed to us to look over and sign and where to send the first payment to. We had to send a Money Order(s) which 1st payment of $1470 was sent in two separate M.O's ($1000.00 & $470) they were sent on 10/13/16. We had to send in documents (my husband's paystubs, my disability statement, hardship etc) The hardship is based on me (Sharon)being on Permanent Disability. At the time of starting this process we owed our September 2015 mortgage payment and was in October 2015 and was going to send both payments into our mortgage company and David Anderson is the one that said instead of sending it in to the mortgage company that money can be used to pay Evergreen to represent us. David said that Jessica Ortaga would be the Underwriting agent working with us. The next 30 day installment payment was due for the remainder of $1470 for which my husband and I both spoke to David stating that we were uncomfortable to pay this kind of money David would say "Trust him" Evergreen will not allow you to lose your home Evergreen will take care of us , On 11/13/15 we(Millers)sent in a M.O for $735.00 because I wanted to make sure that Evergreen was sending the documents into our mortgage company (PennyMac) Than finally on 12/1/15 we sent the final payment of $735.00 so Evergreen received all of $2940. Now here we are in December ,we are 4 months behind on mortgage payments and no resolution from Evergreen we were told that the process of these Modifications usually take about 45-90 days we were getting past that time frame and moving ahead with nothing, Jessica would send an email stating to send paystubs, bankstatements we did all what was asked . Emails exchanged drastically with myself(Sharon) and Jessica and I would even include David Anderson on these emails asking what is going on .Oct emails-44,Nov emails-26, Dec 16 or more, Jan 2016 emails-15 or more, Feb emails-37, March emails-52, April emails- 13, in the one email from Jessica here in March 2016 states for me to stop Complaining that she is working with PennyMac to get this resolved. We (Millers) are now 8 months behind and received Foreclosure papers. All of this info was sent to Evergreen to fix this since they were paid to represent us . Last week 4/18/16-4/22/16 I reached out to PennyMac myself to find out that Evergreen has done Nothing. Angel (PennyMac) is whom I have been working with I asked if Evergreen(Jessica) has/had called in or send our document(s) into PennyMac Angel said that when Jessica has called ,that since our home is in foreclosure she has to speak to a Loan processor or the Underwriting dept Jessica will just come off with "Why are you calling the Millers ) and each Rep that Jessica speaks to she is told what documents are still needed for our case to send on to Underwriting for processing, these documents Jessica never sends them in. Jessica never asks for an update when she has called in. Jessica's call list into PennyMac is month of Dec2015-1-time, Jan 2016-Nothing,Feb 2016-2/8-Jessica mailed documents was asked why when Jessica can fax them- 2/11/16-Jessica was told by the rep what documents were needed to move forward. 2/24/16-Jessica called in spoke to Victoria asked to re-open our case. - Jessica called PennyMac- 3/1 ,3/9, 3/21, 3/23, 3/29 & 3/31-spoke to Alice, Ashley, Roberto, Jeanette,& LaShanda each time she is told what documents are needed and Jessica sits on this.
From 4/9/16 to now there has been no call from Jessica(Evergreen to PennyMac) Last time I received a call from Jessica was on 3/31/16 she than called me on Thursday 4/21/16 around 2:00pm our time to say that she was waiting on a call back from PennyMac (knowing I have sent her emails and left her messages that the deadline was 4/22/16 to get the needed documents to PennyMac) she than said that David received emails from me and voice message did I still want to speak to him I said yes, David gets on the phone and says that Jessica has done everything needed to work with PennyMac and that since our case was taking longer that he wanted additional $1470.00 to move forward and he also said that PennyMac told Jessica that "we wanted to sell our home" I told him he was a liar because if that was the case why was Evergreen hired to get us the Govt loan and work for us ,this was never mentioned throughout this process he said for me to speak to my husband and get back to them David and I argued over this with the selling of our home and David said well Sharon we can play the blame game or move forward he than said did I wish to speak to Jessica again I said yes and she and I just said that I want this done you people got money to represent us with our mortgage company and it went from owing 2 months to 8 months and foreclosure papers
On Friday 4/22/16 Angel(PennyMac) and myself(Sharon) did a 3 way call to Jessica (Evergreen-800-694-9914 X5150, to find out where these needed documents are and it goes into her voice mail Angel left Jessica a message who she (Angel) was and to reach out to her regarding these needed documents, there was a total of 3 calls placed to Jessica on Friday 4/22/16
On Monday 4/25/16 Angel(PennyMac) reached out to David Anderson (Evergreen-800-694-9914 X 5153 David answered the phone and Angel(PennyMac) identified who she was and left David know that I was on the call , Angel wanted to know where the needed documents were and David said that Jessica has sent PennyMac everything and that Jessica has 3 contacts that she is working with Angel asked for us to speak to Jessica and David tried to get her to our call but was not able to so David asked for Angel to call back so Angel/myself called again to David's number and he answered and Angel again identified herself and said that I was on the call David said that he would not speak to me and he would turn the call over to Jessica the phone rang to Jessica and she finally answers and again Angel identified herself and left Jessica know that I was on the call as well Jessica's reply to us was , she asked Angel how long have you been on this case ,Angel replied last week when the homeowners (Millers) reached out to PennyMac due to foreclosure papers well Jessica said she has a "Point of Contact person" named Breonna and she is the only person that she will speak to , I spoke up and said thru the trail of reps at PennyMac there is NO documentation that you have spoken to Breonna and how hard was it for Evergreen ,you Jessica to send PennyMac the needed documents so that we do not lose our home you people like David and yourself take homeowners money and than you don't want to do what you say your going to do, with that , Jessica hung up on our call. Right after the call ended, I received an email at 3:18 pm our time from David Anderson (Evergreen) that "We are no longer working on your file. Sharon has broke Evergreen Contract". I sent email back to David and put Jessica on the email " that I Sharon would like to know what part of the Contract that was broke ? We (Millers) would like our money refunded back " there has been no reply . There was never a time that we the homeowners were not allowed to speak to our mortgage company when PennyMac called us I would send an email to Jessica letting her know.
From October 2015 up to April 25, 2016 Evergreen Legal Service (David & Jessica ) has done nothing to help us to get a Modification done they have hurt us deeply with their Lies."
