Statement of Claim
Claimant says:
"After researching furniture refinishers, I discovered Maurer Woodshop in Boonville, IN. Clint Simpson appeared to be extremely gifted as a restorer/refinisher. I hired and paid him $3,645 to do the work on 2 corner cabinets, an old radio cabinet, a child's rocker, a small stool, a small header for over a window, a small church pew, and to repair the top to my roll top desk. This was a HUGE amount to pay someone to do this work, but I REALLY wanted it to look beautiful, so I thought it was worth it. I signed a contract, paid him during the time frame he had the furniture, and had good faith that he would do a professional job. The day he delivered the items, I was at once shocked and not pleased with his work. Several items were extremely rough, did not have screw/nail holes filled in, still had small places where the paint that was removed could still be seen, the hardware on the radio was not cleaned or burnished, the sides of the corner cabinet were not repaired, etc. I wrote him an email, and also spoke to him on the phone about my displeasure in the job done. He said it was "old" , "dried out" furniture, and it could not be made smooth. I told him I felt like he needed to make an adjustment to the bill I had paid. I was and still am shocked at the job he did for the amount I paid him. He said he had done an excellent job and would not be refunding any of the money I paid him. I told him I would like to settle this between the 2 of us, but I would take him to court if I needed to do that. He said that was fine. So, this is where I am now. Without a doubt, he misrepresented his skills to me. He is by no way a master wood worker. Please advise me as to what you think would be best for me to do about this."

Additional Communication Between Claimant and Clint Simpson Hide
  • Sep 24, 2012, Clint Simpson (responding party) added:
  • Your contract was with Maurer Woodshop LLC, and not me personally. Maurer Woodshop LLC is out of business, and the articles of dissolution were filed with the State of Indiana, back in May, after your projects were completed. Therefore, no legal action can be taken against me personally, and Maurer Woodshop LLC no longer exists and has no assets. That is why we did not charge you a storage fee for keeping your items after completion, even though your contract said we were allowed to charge $10 per week per item for storage.

  • Mr. Simpson did pick up and make the piano stool, the small step stool, and the small rocking chair look somewhat better. He did not repair the roll top on the desk that he was paid to do, and he refuses to refund my money or make an adjustment on the cost. He has not mentioned anything about refinishing the radio cabinet in a professionally acceptable way. Nor has he offered to make the 2 corner cabinets acceptable. He seems to have tried to cover his bases by saying his business is no longer a business and nothing can be done personally to him. However I think this is bogus, and it also shows the shoddy character of Mr. Simpson which matches his work. I am still not satisfied, and really wonder how many others are out there that have been taken by him?
